THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests removal of Permanent Order (PO) Number 67-02 from his record.
2. The applicant states PO Number 67-02, dated 16 June 2010, awarded the Meritorious Unit Commendation to Headquarters and Headquarters Company (HHC), 2nd Battalion, 8th Cavalry Regiment, for service from 8 February 2009 through 5 December 2009. During this period he was not assigned to this unit and he should not have been awarded this award. He was on a permanent change of station from this unit prior to the unit deploying and earning the Meritorious Unit Commendation. He wants the orders removed from his Army Military Human Resource Record (AMHRR) and board file. He is eligible for the sergeant first class promotion board and this order makes his records inaccurate.
3. The applicant provides copies of his Enlisted Record Brief and PO Number 67-02.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army on 16 January 2002 and was assigned to HHC, 2nd Battalion, 8th Calvary Regiment, from 1 June 2003 through 20 January 2008.
2. He provided a copy of PO Number 67-02, dated 16 June 2012, which cited award of the Meritorious Unit Commendation to HHC, 2nd Battalion, 8th Cavalry Regiment, for service from 8 February 2009 through 5 December 2009.
3. A review of his record located on the Interactive Personnel Electronic Records Management System (iPERMS) revealed the contested orders.
4. Army Regulation 600-8-104 (AMHRR Management) prescribes the policies governing the AMHRR Management Program and it composition. The regulation states once a document is placed in the AMHRR it become a permanent part of that file and will not be removed from that file or moved to another part of the file unless directed by the proper authorities listed in the regulation.
DISCUSSION AND CONCLUSIONS:
The applicant was not eligible for the Meritorious Unit Commendation because he was not a member of the unit during the period the unit was cited for the award. Therefore, he is entitled to have PO Number 67-02, dated 16 June 2010, removed from iPERMS.
