IN THE CASE OF:
BOARD DATE: 13 May 2014
DOCKET NUMBER: AR20140000626
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his last DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he was awarded the Army Achievement Medal.
2. The applicant states his last DD Form 214 indicates the Air Force Achievement Medal; it should be an Army Achievement Medal, not Air Force. His final discharge DD Form 214 from the U.S. Air Force (USAF) does not indicate he was awarded the Air Force Achievement Medal. He received the Army Achievement Medal on 1 December 2012.
3. The applicant provides DD Forms 214 dated 12 December 1989 and 17 November 2010.
CONSIDERATION OF EVIDENCE:
1. The applicant served in the Regular Air Force from 11 August 1983 until he was honorably discharged on 12 December 1989. His DD Form 214 for the period ending 12 December 1989 does not show the Air Force Achievement Medal.
2. On 9 August 2008, the applicant enlisted in the Maryland Army National Guard (MDARNG).
3. The applicant was ordered to active duty for training (ADT) on 12 October 2010. He was released from ADT on 17 November 2010 to accept an appointment in the MDARNG in the rank of warrant officer one (WO-1). His DD Form 214 for the period ending 17 November 2010 shows, in part, the Air Force Achievement Medal.
4. On 18 November 2010, the applicant accepted an appointment in the MDARNG in the rank of WO-1.
5. The applicant was ordered to ADT on 29 October 2011. He was released from ADT at the completion of his required active service on 3 July 2012. The DD Form 214 he received does not show he was awarded the Army Achievement Medal but does show he was awarded the Air Force Achievement Medal.
6. On 1 December 2012, the applicant was awarded the Army Achievement Medal for the period 26 through 30 November 2012.
7. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214. It states the DD Form 214 is a synopsis of the Soldiers most recent period of continuous active duty. It states that item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) will contain all authorized awards, as contained in the Army's awards regulation, for all periods of service.
DISCUSSION AND CONCLUSIONS:
1. The applicant's contentions have been noted. His supporting evidence has been considered.
2. The applicant was not awarded the Army Achievement Medal until 1 December 2012. The DD Form 214 that he is requesting to have corrected covered his period of active duty service from 29 October 2011 through 3 July 2012. The Army Achievement Medal is properly not shown on that DD Form 214 because it was awarded for a later period of service.
3. In view of the foregoing, the applicant's request should be denied.
4. It was not clear if the applicant was requesting that the Air Force Achievement Medal be deleted from his DD Forms 214 for the periods ending 17 November 2010 and 3 July 2012. Therefore, no action will be taken regarding that award at this time.

The applicant requests, in effect, adjustment of the effective date/date of rank for his Federal recognition order promoting him to chief warrant officer two (CW2) from 19 February 2013 to 5 September 2012. Public Law 112-239, dated 2 January 2013, provides that if a warrant officer one (WO1) of the National Guard is promoted to the grade of chief warrant officer two (CW2) to fill a vacancy in a federally recognized unit in the National Guard Federal recognition is automatically extended to...

However, due to an error, he did not receive FEDREC until 3 January 2012 (though the effective date was 4 August 2009). As the NGB advisory opinion notes, WO appointments were put on hold for many months following the change in the law as the NGB made adjustments to its appointment process. The delay in processing the applicant's initial appointment to WO1 would have had the effect of delaying his eligibility for promotion to and FEDREC as a CW2.

The applicant requests: * correction of his date of rank (DOR) to chief warrant officer two (CW2) from 19 February 2013 to 10 November 2012 and his time in grade (TIG) * compensation for the wages he lost as a result of his delayed promotion 2. However, given the fact that the State published the promotion order on 21 November 2012 and the fact that delays in his packet being processed both at the State level and at NGB were no fault of the applicant, and now based on Public Law 112-239, as...

The applicant requests correction of his date of rank (DOR) for chief warrant officer two (CW2)/pay grade W-2. The applicant states he was appointed as a warrant officer one (WO1)/pay grade W-1 on 7 April 2009. The evidence of record shows the applicant executed an oath of office in the rank of CW2 on 7 April 2011 and MDARNG orders, dated 19 April 2011, announced his promotion to CW2 effective and with a DOR of 7 April 2011.

Application for correction of military records (with supporting documents provided, if any). With respect to the applicants period of active duty service during September 2001, the evidence of record shows that he performed a period of service that was less than 90 days; therefore, he was not issued a DD Form 214 for that period of service. Furthermore, his period of active duty service in September 2001 occurred outside the period covered by his DD Form 214 from 15 November 1990 to 22...

It appears this award recommendation was not processed at the time because the U.S. Army Awards and Decorations Board required the endorsement of the senior Special Forces commanders in 2003 during Operation Enduring Freedom. e. It is the responsibility of any individual having personal knowledge of an act, achievement, or service believed to warrant the award of a decoration to submit a formal recommendation into military command channels for consideration within 2 years of the act,...

The DD Form 214 documenting this period of service shows he was awarded MOS 11C1P and held this MOS for 2 years and 8 months. A DD Form 214 shows he served on active duty from 10 to 14 June 1991. Although the record shows he held PMOS 11C1P when he was ordered to active duty on 16 June 1991, it appears he was awarded MOS 75B1O during this period of active duty service.

The applicant contends that his DD Form 214 should be corrected to show the Army Reserve Components Achievement Medal, the Army Reserve Components Overseas Training Ribbon (2nd Award), and the Armed Forces Reserve Medal with Hourglass and M device. With respect to award of the Army Reserve Components Achievement Medal, the evidence of record shows the applicants immediate commander awarded him the Army Reserve Components Achievement Medal for service from 10 December 1986 through 10...
