THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his 2013 DD Form 214 (Certificate of Release or Discharge from Active Duty) to show all of his authorized awards.

2.  The applicant states he was awarded a second award the Air Medal, and he was also awarded the Army Achievement Medal and the Combat Action Badge. He qualified for the Iraq Campaign Medal with two bronze service stars (vice one bronze service star) for participation in the National Resolution and Iraqi Surge campaigns.  In addition, he qualified for a second "M" (Mobilization) Device to be affixed to his Armed Forces Reserve Medal based on his mobilization in support of Operation Enduring Freedom (OEF).

3.  The applicant provides copies of two of his DD Forms 214, Iraq Campaign Medal campaign (bronze service) stars sheet, one Army Achievement Medal and two Air Medal award certificates, and Combat Action Badge orders.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the U.S. Army Reserve (USAR) on 12 January 2004 for a period of 8 years.

2.  A DD Form 214 shows he was ordered to active duty for training (ADT) on 
26 April 2004, honorably released from ADT on 22 September 2004, and transferred to a USAR unit.  He had completed 4 months and 27 days of net active service this period.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) shows the Army Service Ribbon.

3.  A DA Form 4980-14 (Army Commendation Medal Certificate) shows Headquarters, 15th Sustainment Brigade, Camp Taji, Iraq, Permanent Order Number 162-09, dated 11 June 2007, awarded the applicant the Army Commendation Medal for meritorious service from 18 September 2006 to 
2 September 2007.  It also shows the applicant was assigned to the
442nd Quartermaster Company, 68th Combat Sustainment Support Battalion.

4.  A DD Form 214 shows he was ordered to active duty in support of Operation Iraqi Freedom (OIF) on 23 June 2006, honorably released from active duty (REFRAD) on 5 October 2007, and transferred to a USAR unit.  He had completed 1 year, 3 months, and 13 days of net active service this period that included 11 months and 15 days of foreign service.

   a.  It also shows in item 13, as corrected by a DD Form 215 (Correction to 
DD Form 214), dated 16 April 2009, the –

* Army Commendation Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Iraq Campaign Medal with one bronze service star
* Army Service Ribbon
* Overseas Service Ribbon
* Armed Forces Reserve Medal with "M" Device

	b.  item 18 (Remarks) shows he served in Iraq from 17 September 2006 to 
1 September 2007.

5.  The applicant was appointed as a reserve officer in the Army National Guard of the United States and Pennsylvania Army National Guard (PAARNG) in the rank of warrant officer one on 7 April 2009.

6.  A DA Form 4980-18 (Army Achievement Medal Certificate) shows Headquarters, 1st Battalion, 14th Aviation Regiment, Fort Rucker, AL, Permanent Order Number 337-001, dated 3 December 2010, awarded the applicant the Army Achievement Medal for exceptionally meritorious achievement as distinguished honor graduate of the AH-64D Initial Entry Rotary Wing Course, Class 10-009, from 30 June 2010 to 3 December 2010.


7.  A DD Form 214 shows he was ordered to ADT on 7 April 2009, honorably released from ADT on 16 December 2010, and transferred to a PAARNG unit.  He had completed 1 year, 8 months, and 10 days of net active service this period.

   a.  He completed the Initial Entry Rotary Wing Course and was awarded primary specialty 152H0 (AH-64D Attack Pilot).

   b.  It also shows in item 13 the –

8.  A DA Form 4980-9-WT (Air Medal Certificate) shows Headquarters, Combined Joint Task Force-101, Permanent Order Number 126-034, dated 
6 May 2013, awarded the applicant the Air Medal for exceptionally meritorious achievement in aerial flight in support of OEF on 22 March 2013.

9.  A DA Form 4980-9-WT shows Headquarters, Combined Joint Task Force -101, Permanent Order Number 213-023, dated 1 August 2013, awarded the applicant the Air Medal (2nd Award) for exceptionally meritorious achievement in aerial flight in support of OEF from 12 December 2012 to 10 August 2013.

10.  Headquarters, Task Force Falcon, 10th Combat Aviation Brigade, Regional Command–East, Bagram Airfield, Afghanistan, Permanent Order Number 
192-017, dated 11 July 2013, awarded the applicant the Combat Action Badge for actions on 15 June 2013.

11.  A DD Form 214 shows he was ordered to active duty in support of OEF on
21 August 2012 and was honorably REFRAD on 31 October 2013.  He had completed 1 year, 2 months, and 10 days of net active service this period that included 8 months and 2 days of foreign service.


   a.  It also shows in item 13 the –

	b.  item 18 shows he served in Afghanistan from 10 December 2012 to 
11 August 2013.

12.  A review of the U.S. Army Human Resources Command, Military Awards Branch, "Recently Approved Unit Awards" listing shows the 442nd Quartermaster Company was cited for award of the Meritorious Unit Commendation for the period 15 September 2006 to 10 September 2007.

13.  Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations.

	a.  The Iraq Campaign Medal is authorized for award to members of the Armed Forces of the United States who served in direct support of OIF.  The area of eligibility encompasses all land area of the country of Iraq and contiguous water area out to 12 nautical miles and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles.

	 	(1)  The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 to 31 December 2011 (the cessation of OIF).

		(2)  A bronze service star is authorized with this service medal for each Iraq campaign a member is credited with participating in.  During the applicant's period of service in Iraq, participation credit was awarded for the following two campaigns:

* National Resolution (16 December 2005 - 9 January 2007)
* Iraqi Surge (10 January 2007 - 31 December 2008)
	b.  The Armed Forces Reserve Medal is awarded for honorable and satisfactory service as a member of one or more of the Reserve Components for a period of 10 years.  Also qualifying for this award are members who, on or after 1 August 1990, were called to active duty and served under Sections 12301(a), 12302, 12304, 12406, Title 10, U.S. Code, or, in the case of the U.S. Coast Guard Reserve, Section 712 of Title 14, U.S. Code.

    	(1)  The "M" Device is authorized for wear on the Armed Forces Reserve Medal by members of the Reserve Component who are called or who volunteer and serve on active duty in support of U.S. military operations or contingencies designated by the Secretary of Defense, as defined in 10 USC 101(A)(13).

    	(2)  When a member qualifies for the "M" Device, the bronze "M" will be awarded, positioned on the ribbon and medal, and a number will be included on the ribbon and medal.  Multiple periods of service during one designated contingency will count as one "M" Device award.

14.  Department of Defense (DoD) Manual 1348–33 (Manual of Military Decorations and Awards:  DoD Service Awards – Campaign, Expeditionary, and Service Medals) provides procedures and guidance regarding creation, activation, and award of DoD service awards.  Enclosure 3 (DoD Campaign, Expeditionary, and Service Medal Procedures), paragraph 6 (Armed Forces Reserve Medal), in pertinent part, lists the specific U.S. military operations or contingencies designated by the Under Secretary of Defense for Personnel and Readiness and shows the War on Terrorism includes ONE (United States), OEF (Afghanistan), and OIF.  It also shows that multiple periods of service during one designated contingency shall count as one "M" device award.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends his DD Forms 214 should be corrected to show all of his authorized awards and decorations.

2.  Permanent orders awarded the applicant the:

* Army Achievement Medal for the period 30 June to 3 December 2010
* Air Medal on 22 March 2013
* Air Medal (2nd Award) for the period 12 December 2012 to 10 August 2013
* Combat Action Badge on 15 June 2013


3.  The evidence of record shows the applicant qualified for award of the Iraq Campaign Medal and that he participated in two campaigns during his service in Iraq from 17 September 2006 to 1 September 2007.  Thus, he is entitled two bronze service stars for wear on his previously-awarded Iraq Campaign Medal.

4,  The evidence of record shows the applicant's unit was awarded the Meritorious Unit Commendation for the period 15 September 2006 to 
10 September 2007.

5.  Records show the applicant was ordered to active duty on 23 June 2006 in support of OIF and he was also ordered to active duty on 21 August 2012 in support of OEF.

   a.  The evidence of record shows that the War on Terrorism includes OIF and OEF and that multiple periods of service during one designated contingency shall count as one "M" device award.  As such, he qualified for award of the Armed Forces Reserve Medal with "M" Device for his service in support of the War on Terrorism (OIF and OEF). 

   b.  Thus, the applicant is not entitled to correction of his 31 October 2013 
DD Form 214 to show the Armed Forces Reserve Medal with "M" Device and Numeral "2."

6.  Therefore, it would be appropriate to correct the applicant's DD Forms 214 to show his awards and decorations, as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* deleting the "Iraq Campaign Medal with one bronze service star"
* adding the –

* Iraq Campaign Medal with two bronze service stars
* Meritorious Unit Commendation

	b.  correcting item 13 of his 16 December 2010 DD Form 214 by –

* deleting the "Iraq Campaign Medal w/ campaign star"
* adding the –

* Army Achievement Medal
* Iraq Campaign Medal with two bronze service stars
* Meritorious Unit Commendation

   c.  correcting item 13 of his 31 October 2013 DD Form 214 by –

* deleting the –

* "Air Medal"
* "Iraq Campaign Medal w/ campaign"

* adding the –

* Air Medal (2nd Award)
* Army Achievement Medal
* Iraq Campaign Medal with two bronze service stars

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to the Armed Forces Reserve Medal with "M" Device and Numeral "2."
