THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of item 11 (Primary Specialty) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his Area of Concentration (AOC) as 68H (Pharmacy Officer).

2.  The applicant states the designator was changed from 68H to 67E (Patient Administration Officer) a few years prior to his retirement.  Future employment as a pharmacist requires that his DD Form 214 reflect that he was a Pharmacy Officer.  Items 14 (Military Education) and 18 (Remarks) of his DD Form 214 reference his Pharmacy Officer related courses, etc.

3.  The applicant provides a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provide in the statute of limitations, the ABCMR has elected to conduct a substantive review of the cases and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are sufficient bases to waive the statute of limitations.
2.  The applicant was commissioned in the U.S. Army Reserve, Medical Services, on 21 March 1982, with prior U.S. Army Reserve (USAR) and Army National Guard (ARNG) enlisted and commissioned service.  He entered active duty on 29 June 1983.

3.  His DA Form 2-1 (Personnel Qualification Record – Part II) shows in:

* Item 6 (Military Occupational Specialty) - 68H0O, Pharmacy Officer, 14 September 1982
* Item 17 (Civilian Education and Military Schools) – University of Cincinnati, OH, Pharmacy, 5 years, Bachelor of Science, 1983
* Item 35 (Record of Assignments) – 68H0O from 1 July through 29 October 1983

4.  He was retired on 28 February 1999.  His DD Form 214 lists in:

* Item 11 – 67E, Patient Administration Officer, 15 years and 8 months
* Item 14 – the

Army Medical Pharmacy Services Orientation Course, 2 weeks, 1983
American Society of Healthcare Pharmacists Hospital Pharmacy Residency Course, 52 weeks, 1991

5.  The U.S. Army Human Resources Command (HRC) Officer Branch History Chart, shows the AOC 68H was changed to 67E in 1993.

6.  Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that would be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army.  It established standardized policy for preparing and distributing the DD Form 214.  The regulation stated in:

* Item 11 – would list all AOCs for officers served for at least 1 year and include for each AOC the number of years and months served.
* tem 14 – would list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214; and title, length in weeks, and year completed.

DISCUSSION AND CONCLUSIONS:

The applicant served on active duty as a Pharmacy Officer in AOC 68H.  In 1993, the Army changed the designation or numbering for this AOC from 68H to 67E.  However, the title for this AOC remained Pharmacy Officer.  For unknown reasons, the applicant's DD Form 214 listed his AOC as 67E with the title as Patient Administration.  Therefore, item 11 of his DD Form 214 should be corrected to show he served in AOCs 68H and 67E as a Pharmacy Officer from the date of entry on active duty to the date of retirement.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from item 11 of the applicant's DD Form 214 the entry, "67E Patient Administration Officer – 15 years, 8 months" and replacing it with the entry "67E/68H Pharmacy Officer -15 years 8 months."
