THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) as follows: 

* item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) to add the Legion of Merit
* item 18 (Remarks) to add the Additional Skill Identifier (ASI) of 3H (Joint Planner) and 6P (Master Fitness Trainer) to his specialty

2.  The applicant states:

* he was awarded the Legion of Merit on 13 November 2014 by U.S. Army, Pacific Fort Shafter, HI Permanent Order Number (PO) 317-1; he received the award after his retirement 
* he was awarded ASI 3H on 13 June 2008 and ASI 6P on 22 February 1999; he noticed his DD Form 214 listed the ASI of 6T (Military Auditor) but not 3H or 6P 

3.  The applicant provides:

* DD Form 214 and Officer Record Brief (ORB)
* PO Number 317-1
* DA Form 638 (Recommendation for Award)
* Memorandum of Qualification for Joint Planner ASI 3H
* DA Form 1059 (Service School Academic Evaluation Report)
* 
Master Fitness Trainer Course certificate
* Memorandum of Award of ASI 6P

CONSIDERATION OF EVIDENCE:

1.  The applicant's records show he was appointed as a Reserve commissioned officer of the Army and executed an oath of office on 18 June 1991.  He completed the Finance Officer Basic Course. 

2.  He entered active duty on 10 September 1995, served in a variety of assignments, and he was promoted to lieutenant colonel (LTC).

3.  He retired on 31 December 2014 and he was placed on the Retired List, by reason of sufficient service for retirement, in his retired rank of LTC on 1 January 2015.  His DD Form 214 shows in: 

* Item 11 (Primary Specialty), 36A 6P 3H FINANCIAL MANAGER 19 YRS, 4 MOS
* Item 13, does not show the Legion of Merit
* Item 14 (Military Education), multiple training courses (including the Master Fitness Course, 2 weeks, completed in 1998 and the Command and General Staff College-Intermediate Level Education (CGSC-ILE), completed in 2008); continued in item 18
* Item 18, multiple mandatory or lengthy entries, including the entry "ASI 6T Military Auditor" 

4.  He provides and his records contain: 

	a.  DA Form 638 and certificate, dated 10 December 2014, showing award of the Legion of Merit, by PO Number 317-1, issued by Headquarters, U.S. Army Pacific. 

	b.  DA Form 1059, dated 13 June 2008, showing completion of the U.S. Army Command and General Staff Officer Course at Fort Leavenworth, KS from 13 August 2007 to 13 August 2008.  Item 14 (Comments) of this form shows the entry "Achievements: Completed the Joint Planning Course to earn ASI 3H." 

	c.  A memorandum, dated 13 June 2008, issued by the Director of Joint Planner Program, U.S. Army Combined Arms Center, Fort Leavenworth, awarding him ASI 3H.

	d.  A certificate showing completion of the 2-week Master Fitness Trainer Course from 25 January to 6 February 1998. 
	e.  A memorandum, dated 22 February 1999, approving award of ASI 6P effective that date. 

5.  Army Regulation 635-8 (Separation processing and Documents) prescribes the transition processing function of the military personnel system.  It provides principles of support, standards of service, policies, tasks, rules, and steps governing required actions in the field to support processing personnel for separation and preparation of separation documents.  Chapter 5 of this regulation states the DD Form 214 is a summary of the Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge.  

	a.  Item 11, enter the titles of all military occupational specialties (MOS) or areas of concentration (AOCs) awarded and held for at least 1 year during the current period of service and include for each MOS/AOC the number of years and months held.  For time determinations, 16 or more days counts as a month. Do not count time in training (basic training, advanced individual training, Basic Officer’s Leader Course, or MOS-producing school).  For commissioned officers, specify the AOC consisting of two numbers and one letter.  Up to two ASI or special skill identifiers are allowed immediately following the AOC.  

	b.  Item 13, list all federally recognized awards and decorations for all periods of service.  Do not use abbreviations.  

	c.  Item 14, list all formal, in-service (full time attendance) training courses successfully completed during the period of service covered by the DD Form 214 of at least 1 week or 40 hours duration.  Include course title, length in weeks, and year completed.  This information is to assist the Soldier in job placement and counseling; therefore, do not list training courses for combat skills.

	d.  Item 18, this block is used for Headquarters, Department of the Army mandatory requirements when a separate block is not available; as a continuation for entries in blocks 9, 11, 13, and 14; or for conditional entries (listed in the regulation). 

DISCUSSION AND CONCLUSIONS:

1.  PO awarded the applicant the Legion of Merit which is not listed on his DD Form 214; therefore, his DD Form 214 should be corrected to show this award. 


2.  With respect to the ASI: 

	a.  An officer's ASI is listed in item 11 of the officer's DD Form 214.  The applicant held AOC 36A and he was awarded ASI 6P and ASI 3H.  Both ASI's are correctly reflected in item 11 of his DD Form 214. 

	b.  ASI 3H is awarded upon qualification as a joint planner.  The applicant met the qualifications for this ASI while enrolled in CGSC-ILE.  The CGSC-ILE course is already reflected in item 14 of his DD Form 214.  His qualification as a joint planner was not a separate training course, taken independently of CGSC-ILE.  Because it is not a separate training course and because it is already reflected in item 11, there is no reason to list it in item 18. 

	c.  ASI 6P is awarded upon completion of the Master Fitness Course and award of the ASI.  The applicant met the qualification for this ASI and the ASI itself is already listed in item 11 while the training that led to the ASI is listed in item 14.  Because both the ASI and the training that led to it are properly listed in the respective blocks, there is no reason to list the ASI in item 18

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 13 of his DD Form 214 the Legion of Merit.


2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to adding ASI 6P and 3H to item 18 of his DD Form 214.
