THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his correct Social Security Number (SSN) and his rank as E-4.

2.  The applicant states his DD Form 214 reflects an incorrect SSN  his SSN should be xxx-x2-x325 instead of xxx-20-x273and shows his rank as E-1 instead of E-4.

3.  The applicant provides copies of his DD Form 214, Enlistment Contract, Social Security Card, and birth certificate. 

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Texas Army National Guard (TXARNG) on         16 April 1977 and at the time of his enlistment his SSN was recorded as being the same as is reflected on his Social Security Card.

2.  He was ordered to initial active duty training (IADT) on 3 July 1977.  He completed his one-station unit training as an armor crewman at Fort Knox, KY and he was honorably released from IADT on 12 November 1977 in the pay grade of E-1.  His DD Form 214 issued at the time of his release from IADT reflects an SSN of xxx-20-x273 instead of xxx-x2-x325, a rank of “PV1/E-1,” and date of rank of 16 April 1977.

3.  He was returned to his TXARNG unit, and he was advanced to the pay grade of E-2 on 3 January 1978.  On 13 January 1979, he was discharged from the TXARNG.

4.  Army Regulation 635-5 (Separation Documents), in effect at the time, served as the authority for the preparation of the DD Form 214.  It provided that the DD Form 214 would be prepared to reflect information as it existed in the official records at the time of separation.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s contention that his SSN is incorrectly depicted on his            DD Form 214 has been noted and found to have merit.  It appears that during the preparation of his DD Form 214 a clerical error occurred resulting in an incorrect SSN being listed.

2.  Accordingly, his DD Form 214 should be corrected to show his SSN as the SSN shown on his Social Security Card.

3.  The applicant’s contention that his rank should be reflected as “E-4” instead of “E-1” has also been noted.  The applicant was still serving in the pay grade of    E-1 when he was released from IADT.  Accordingly, his DD Form 214 reflects his proper rank and pay grade as it existed at the time of his release from IADT.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the SSN contained in block 3 of his DD Form 214 and replacing it with the SSN contained on his Social Security Card.


2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to changing his DD Form 214 to reflect his rank/pay grade as E-4.
