THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the last three digits of his social security number (SSN) as "274" instead of "086."
2. He states the SSN on his DD Form 214 incorrect. It should be xxx-xx-x274.
3. He provides his DD Form 214 and social security card.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 17 November 1965 and he was honorably released from active duty on 15 November 1968. His DD Form 214 shows the last three digits of his SSN as "086."
3. His service record contains Letter Orders Number 11-1258271, dated 3 November 1971, which lists the last three digits of his SSN as "274."
4. He provided a copy of his social security card which lists the last three digits of his SSN as "274."
5. Army Regulation 600-2 (Name and Birth Data, Social Security Account Number, and Temporary Identification Number) prescribed the procedures used for recording, issuance or changing of several items of personnel information normally used as a means of personnel identification, specifically the SSAN. This regulation specified that the transfer from the use of a service number to the SSAN was effective 1 July 1969.
DISCUSSION AND CONCLUSIONS:
1. The applicant entered active service on 17 November 1965. At that time, a military service number was assigned for the purpose of identification. However, his military personnel record contains a document that shows the last three digits of his SSN as "274." The social security card provided by the applicant also confirms the last three digits of his SSN as "274."
2. The applicant's DD Form 214 does not list the SSN with the last three digits as it is listed on the social security card. Therefore, his DD Form 214 should be amended to list the SSN as it is listed on the social security card.
