		BOARD DATE:	  3 April 2014

		DOCKET NUMBER:  AR20130014438

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he was deployed to Afghanistan from
15 March to 8 December 2012.

2. The applicant states his DD Form 214 indicates he was deployed to Iraq during the period in question. He contends the personnel clerk simply made a mistake.

3. The applicant provides copies of:

* DD Form 214
* North Atlantic Treaty Organization (NATO) Travel Order Number ST-045-0624, dated 14 February 2012
* Orders ST-045-0624, Third Infantry Division, dated 14 February 2012
* Orders ST-045-0624 (A1), Third Infantry Division, dated 13 September 2012

CONSIDERATION OF EVIDENCE:

1. On 30 June 2005, the applicant enlisted in the Regular Army

2. Orders ST-045-0624, as provided by the applicant, indicate he was deployed to Afghanistan in support of Operation Enduring Freedom (OEF) for a period of 270 days commencing on or about 18 March 2012.

3. Records at the Defense Finance and Accounting Service (DFAS) show that the applicant received hazardous fire pay (HFP) and imminent danger pay (IDP) from 23 March through 30 November 2012 (8 months and 8 days) for service in Afghanistan.

4. On 8 August 2013, the applicant was discharged due to completion of required service. He had attained the rank of sergeant, pay grade E-5 and had completed more than 8 years of active duty service.

5. The applicant's DD Form 214 shows in:

	a.  Item 12f (Foreign Service): 2 years, 0 months, and 29 days;

	b. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) includes the following:

* Afghanistan Campaign Medal with two campaign stars
* Iraq Campaign Medal with campaign star

	c. Item 18 (Remarks): Service in Iraq 20120315-20121208.

6. Army Regulation 635-5 (Separation Documents), as then in effect, provided detailed instructions for completing separation documents, including the DD Form 214.  It provided that Item 18 (Remarks) would contain the following entry for Regular Army Soldiers: "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)."

DISCUSSION AND CONCLUSIONS:

1. The applicant contends that his DD Form 214 should be corrected to show his dates of deployment in Afghanistan.

2. Permanent orders indicate the applicant was ordered to serve in support of OEF for a period of 270 days commencing on or about 18 March 2012.

3. DFAS records show that the applicant received HFP/IDP from 15 March through 8 December 2012 (8 months and 8 days) for service in Afghanistan.

4. However, the applicant's DD Form 214 indicates that he served in Iraq during the period shown in the preceding paragraph. The supporting documents are sufficiently convincing to show that his DD Form 214 should be corrected to show this period of deployment as being in Afghanistan.

    The evidence of record partially supports the applicant's request for correction of item 12f of his DD Form 214. There is no evidence indicating the applicant was actually deployed to Afghanistan for 9 months. In light of the available evidence, it would be appropriate to correct item 12f of his DD Form 214 to show he had 3 months and 8 days of foreign service.
