		BOARD DATE:	  3 April 2014

		DOCKET NUMBER:  AR20130014062

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show in item 12b that he separated on 6 March 2012.

2. The applicant states, in effect, that his DD Form 214 incorrectly reflects that he was separated on 6 March 2011 instead of 6 March 2012.

3. The applicant provides copies of sworn statements, DD Form 214, leave forms, evaluation reports, mobilization orders, awards, and leave and earnings statements.

CONSIDERATION OF EVIDENCE:

1. The applicant was serving in the pay grade of E-5 in the U.S. Army Reserve (USAR) when he was ordered to active duty on 6 January 2011 in support of Operation Enduring Freedom.

2. He deployed to Afghanistan during the period 20110220 – 20111229 and on
6 March 2012 he was honorably released from active duty (REFRAD) due to completion of required service. He had served 1 year, 2 months and 1 day of active service this period. His DD Form 214 issued at the time of his REFRAD shows in item 12b that he was separated on 6 March 2011.

DISCUSSION AND CONCLUSIONS:

1. The applicant’s contention that his date of separation on his DD Form 214 is incorrect has been noted and found to have merit.

2. The applicant was ordered to active duty on 6 January 2011. He served 1 year, 2 months, and 1 day of active service and was REFRAD on 6 March 2012.

3. However, his DD Form 214 incorrectly reflects that he was REFRAD on
6 March 2011, a date that is only 2 months and 1 day after he was ordered to active duty.

4. Therefore, it is reasonable to presume that an administrative error occurred at the time his DD Form 214 was prepared and his separation date (year only) was incorrectly entered as 2011 instead of 2012. Accordingly, it should be corrected at this time.

BOARD VOTE:

__x______  __x______  _x____  GRANT FULL RELIEF

________  ________  ________  GRANT PARTIAL RELIEF

________  ________  ________  GRANT FORMAL HEARING

________  ________  ________  DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

1. The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* Deleting the entry “2011 03 06” from item 12b of his DD Form 214 for the period beginning 2011 01 06
* Adding the entry “2012 03 06” in item 12b of his DD Form 214 for the period beginning 2011 01 06

2. The Board wants the applicant and all others to know that the sacrifices he made in service to the United States during the Global War on Terrorism are deeply appreciated. The applicant and all Americans should be justifiably proud of his service in arms.

    If the day is the 31st day of the month, then change it to 30. When computing creditable service, consider each month as consisting of 30 days regardless of the actual number of days in the month, except when the period of active service ends on 28 February of a leap year; do not change the 28 to 30 since the 29th is the last day of the month. The applicant's last day of service was 18 June 2012, not 28 February 2012.

    The applicant requests reconsideration of his request to have his uncharacterized service changed to an honorable characterization of service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. The applicant was properly released from IADT with uncharacterized service in accordance with the applicable regulation in effect at the time because he had served less than 180 days of continuous active duty.

    However, there is no evidence in his records that show he was awarded MOS 25F or that he was issued a DD Form 214 for this period of service. He then completed 6 months and 10 days when he was ordered to active duty on 1 August 2006 (the DD Form 215 adjusted this date to 28 July 2006) and he was released from active duty on 7 February 2007. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge.
