THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of the social security number (SSN) shown on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).

2.  He states he did not have his social security card in his possession when he was inducted into the Army; therefore, the Army issued him an alternate number.  He used this number throughout his service.  He contends that his correct SSN is 
"XXX-XX-6420" and not "XXX-XX-0313" as listed on his DD Form 214.

3.  The applicant provides his DD Form 214, social security card, and Honorable Discharge Certificate.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  On 28 April 1969, the applicant received a pre-induction medical examination prior to entering the Army.  His records show his SSN is listed as "XXX-XX-6420" on the following documents:

* Standard Form 88 (Report of Medical Examination)
* Standard Form 89 (Report of Medical History)

3.  On 27 August 1969, he was inducted into the Army of the United States.  His DD Form 47 (Record of Induction) shows his SSN as "XXX-XX-0313."

4.  His DD Form 214 shows he was honorably released from active duty on 31 March 1971.  His SSN was entered as "XXX-XX-0313."

5.  He provides a copy of his social security card showing his SSN as 
"XXX-XX-6420."

DISCUSSION AND CONCLUSIONS:

The applicant's pre-induction medical records show the SSN shown on his social security card.  It appears that an error was made in entering the SSN during his induction processing.  Therefore, it would be appropriate to correct his DD Form 214 to show his SSN as it is listed on his social security card.

replacing the SSN entered on his DD Form 214 with the SSN shown on his social security card.
