BOARD DATE: 22 August 2013
DOCKET NUMBER: AR20130000347
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of the social security number (SSN) shown on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).
2. He states the SSN was entered incorrectly on his DD Form 214.
3. He provides copies of his DD Form 214, California driver's license, and social security card.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. On 13 September 1969, the applicant completed a DD Form 398 (Statement of Personal History) in connection with his induction. In item 13 (Employment), he entered his SSN as "XXX-XX-5465."
3. On 16 September 1969, he was inducted into the Army of the United States. His DD Form 47 (Record of Induction) shows he was assigned a temporary identification number (TIN) beginning with "9."
4. Item 1 (Name and Service Number) of his DA Form 20 (Enlisted Qualification Record) shows his TIN was entered and later lined through. His SSN was later entered as "XXX-XX-5465."
5. His DD Form 214 shows he was honorably released from active duty on 15 September 1971. His SSN was entered as "XXX-XX-5462."
6. He provides a copy of his social security card showing his SSN as
"XXX-XX-5465."
DISCUSSION AND CONCLUSIONS:
The evidence shows the SSN shown on the applicant's social security card was properly entered in his record during his military service. It is clear that an error was made when his SSN was entered on his DD Form 214. Therefore, it would be appropriate to correct his DD Form 214 to show the SSN shown on his social security card.

The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his social security number (SNN) as "XXX-XX-6227" vice "9XX-XX-4329." The evidence of record shows the applicant listed his SSN as "XXX-XX-6227" upon his enlistment in the RA. It also appears that the typed TIN was lined through when he received his social security card and the SSN "XXX-XX-6227" was recorded on his DD Form 4.
ARMY | BCMR | CY2014 | 20140015999
Item 2 (SN) of his DD Form 47 (Record of Induction) listed the entry "907-XX-XXXX." This TIN is used throughout his military service. In this case, based on the evidence of record, it would be appropriate to correct his DD Form 214 to show his SSN.
ARMY | BCMR | CY2011 | 20110001437
When he went into the service, he was issued an SSN by the Army. Item 3 (SSN) of his DD Form 214 shows his SSN as "9XX-XX-1193." The evidence of record shows the applicant was inducted into the Army of the United States on 17 September 1969.
ARMY | BCMR | CY2012 | 20120002734
Item 2 (SN) of his DD Form 47 (Record of Induction) listed the entry "917-XX-XXXX." He provides a social security card that shows his name and a different SSN (the number 400-XX-XXXX - the same SSN hand-written on his DA Form 20) than that shown on his DD Form 214. In this case, based on the evidence of record and the evidence he submitted, it would be appropriate to correct his DD Form 214 to show his SSN.

The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his correct social security number (SSN) as "367-XX-XXXX" instead of "925-XX-XXXX." This TIN was used throughout his military service. In this case, based on the evidence of record, it would be appropriate to correct his DD Form 214 to show his SSN.

It states for: a. item 3, enter the individuals SN or SSAN, and b. item 30 (Remarks), this section is used to complete entries too long for their respective blocks. The evidence of record shows that a TIN was used throughout the applicant's military service. However, based on the evidence of record, it would be appropriate to correct only the applicant's DD Form 214 to show his correct SSN.

The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "273-XX-XXXX" instead of "943-XX-XXXX." Nevertheless, based on the evidence of record, it would be appropriate to add an entry in item 30 (Remarks) of his DD Form 214 showing his SSN as indicated on his application to this Board.
