THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he was awarded the Army Good Conduct Medal and the Global War on Terrorism Service Medal.

2.  The applicant states, in effect, that he is authorized the awards by Army Regulation (AR) 600-8-19 (Military Awards).

3.  The applicant provides a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  Following prior Army Reserve service, the applicant enlisted in the Regular Army on 31 January 2000.  He held military occupational specialty 31R (Multichannel Transmission Systems Operator/Maintainer).

2.  His DA Form 2-1 (Personnel Qualification Record – Part II) shows his awards as the Army Service Ribbon, Army Commendation Medal, Army Achievement Medal (2 Awards), National Defense Service Medal, and the Marksman Marksmanship Qualification Badge with Rifle Bar.

3.  He was honorably discharged due to disability with severance pay effective 
13 May 2002 as a specialist (SPC)/E-4.  He had completed 2 years, 3 months, and 13 days during the period covered by his DD Form 214 with no time lost listed.  His DD Form 214 shows his awards as:

* Army Lapel Button
* Army Commendation Medal
* Army Achievement Medal (2 Awards)
* National Defense Service Medal
* Army Service Ribbon
* Marksman Marksmanship Qualification Badge with Rifle Bar

4.  Army Regulation 600-8-22 (Military Awards) states the:

	a.  Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity.  Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified.  The following period of continuous enlisted active Federal military service qualifies for award:  For first award only, upon termination of service on or after 27 June 1950 of less than 3 years but more than 1 year.

	b.  Global War on Terrorism Service Medal is authorized for award to all Soldiers on active duty on or after 11 September 2001 to a date to be determined. 

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s records show he distinguished himself in the performance of his military service as evidenced by him attaining the rank of SPC and receiving personal decorations.  Furthermore, there is no evidence of any misconduct or disciplinary action or a commander's disqualification for award of the Army Good Conduct Medal.  It is presumed that he did not receive the Army Good Conduct Medal due to an oversight.  Accordingly, he should be awarded the Army Good Conduct Medal (1st Award). 

2.  The available evidence shows he served a qualifying period of service for award of the Global War on Terrorism Service Medal.  

3.  His DD Form 214 should be corrected to show these awards.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  awarding him the Army Good Conduct Medal (1st Award) for the period 
31 January 2000 through 12 May 2002; and

	b.  adding to item 13 of his DD Form 214 the Army Good Conduct Medal 
(1st Award) and the Global War on Terrorism Service Medal.
