THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his previous request for correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show two awards of the Meritorious Service Medal.

2.  The applicant states, in effect, he was told he could resubmit his application if he had information contrary to what was available during the initial review of his case.

3.  The applicant provides:

* DD Form 214, dated 31 May 1996
* Permanent Orders Number 247-00001, dated 3 September 1996
* Permanent Orders 53-7, dated 7 July 1992
* Army Board for Correction of Military Records (ABCMR) letter dated, 7 November 2011
* ABCMR Record of Proceedings, dated 3 November 2011
* Army Review Boards Agency, dated 18 March 2013

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20110009661 on 3 November 2011.

2.  During the initial review of the applicant's case, he provided a copy of Permanent Orders Number 53-7 awarding him the Meritorious Service Medal for service for the period 5 August 1988 – 2 June 1992.  This award is shown on the DD Form 214 he received at the time of his retirement from the Army on 31 May 1996.

3.  The applicant now provides Permanent Orders Number 247-00001, dated 3 September 1996, awarding him the Meritorious Service Medal for exceptional meritorious service in various positions of responsibility and trust both overseas and in the United States from 28 September 1975 to 31 May 1996 (the date of his retirement).  

4.  Permanent Orders Number 247-00001 were published after the date of his retirement and this award is not shown on his DD Form 214.

DISCUSSION AND CONCLUSIONS:

1.  Although the applicant retired on 31 May 1996, Permanent Orders Number 247-00001 were not published until 3 September 1996.  However, the orders are for the period 28 September 1975 to 31 May 1996.  Had the orders been timely prepared, this award would have been included on his DD Form 214.

2.  In view of the foregoing, the applicant's records should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20110009661, dated 3 November 2011.  As a result, the Board recommends that all Department of the 

Army records of the individual concerned be corrected by amending his DD Form 214 dated 31 May 1996 to show he was awarded the Meritorious Service Medal (Second Award).
