THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests removal of two memoranda awarding him the Army Reserve Components Achievement Medal and the California Drill Attendance Ribbon from his Army Military Human Resource Record (AMHRR) (formerly known as the official military personnel file (OMPF).
2. The applicant states, in effect:
a. The Army Reserve Components Achievement Medal for the period 12 December 1997 through 12 December 2000 is incorrect because he was serving in a different branch of the military and he did not separate from that branch until 11 December 1998.
b. The California Drill Attendance Ribbon contains the wrong social security number.
c. The existence of the above documents in his AMHRR affects his future promotion potential. He was not given the opportunity to confirm the information was correct.
3. The applicant provides:
* Memoranda awarding him the Army Reserve Components Achievement Medal and the California Drill Attendance Ribbon
* DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States)
CONSIDERATION OF EVIDENCE:
1. The applicant initially enlisted in the U.S. Marine Corps on 12 December 1994. He was honorably released from active duty on 11 December 1998 and he was transferred to the U.S. Marine Corps Reserve for completion of his military service obligation.
2. He enlisted in the California Army National Guard (ARNG) on 29 December 1999. His DD Form 4 and allied documents listed his SSN as "6xx-xx-xxxx." He was assigned to C Troop, 1st Squadron, 18th Cavalry, a subordinate element of the 40th Infantry Division of the ARNG.
3. On 10 December 2001, by memorandum, the applicant's immediate commander authorized him award of the California Drill Attendance Ribbon (1st Award). The memorandum, filed in his AMHRR, listed his SSN as "7xx-xx-xxxx."
4. On 4 June 2002, by memorandum, the applicant's immediate commander awarded him the Army Reserve Components Achievement Medal (2nd Award) from 12 December 1997 to 12 December 2000. This memorandum is also filed in his AMHRR.
5. He was honorably separated from the CAARNG on 25 January 2006 for the purpose of enlisting in another component of the Armed Forces.
6. He enlisted in the Regular Army in the rank/grade of staff sergeant/E-6 on 26 January 2006 and he has since served through multiple extensions or reenlistments.
7. Army Regulation 600-8-104 (AMHRR Management) prescribes policies governing the AMHRR records management. The AMHRR is an administrative record as well as the official permanent record of military Service belonging to a Soldier. The AMHRR is the historical and authoritative source for authentication of veteran or Service-related benefits, entitlements, and services.
a. Paragraph 3-6 states the AMHRR is reflective of an individual Soldiers record and is stored in the interactive Personnel Electronic Records Management System. Within the AMHRR there are various folders that house information regarding an individual military career. Table 3-1 defines these folders as performance, service, restricted, medical, other, and State/territory.
b. Table 3--1 states the "State/Territory folder maintains documents referencing State awards and personnel actions."
8. California ARNG Regulation 600-8-22 (California National Guard Awards and Decorations) prescribes the CAARNGs policies, criteria, and administrative instructions concerning State decorations and awards under the direction of the State Military and Veterans Code, Chapter 640.
a. Paragraph 1-7 states all CARNG unit commanders (company/separate detachment) are authorized to approve and award the following state awards: California Service Medal/Ribbon, California Good Conduct Medal/Ribbon, California Drill Attendance Ribbon, Enlisted Trainers Excellence Ribbon and Enlisted Excellence Ribbon.
b. Paragraph 2-12 states the California Drill Attendance Ribbon is be awarded annually, from the date of enlistment, to any Soldier/Airman, who, while a member of the CAARNG, attends all ordered unit training assemblies and
15 days of Annual Training. Only service in the CAARNG is used to qualify an individual for this ribbon.
9. Army Regulation 600-8-22 (Military Awards) states the Army Reserve Components Achievement Medal is authorized for award to Army personnel, including Active Guard Reserve officers, in the rank of colonel and below for exemplary behavior, efficiency, and fidelity while serving as a member of an ARNG or Army Reserve troop program unit or as an individual mobilization augmentee.
DISCUSSION AND CONCLUSIONS:
1. The applicant's AMHRR contains two documents that the applicant contends should be removed.
2. With respect to the Army Reserve Components Achievement Medal, the applicant was awarded this award for service from 12 December 1997 to 12 December 2000. However, he did not enlist in a Reserve Component (the CAARNG) until 29 December 1999. It appears the award is appropriate but the dates are incorrect. The applicant should request an amendment to this memorandum to reflect the correct dates (and the correct first, not second, award) and have the amendment filed in his AMHRR.
3. The applicant was recognized by his commander and awarded the California Drill Attendance Ribbon. This award is a State award, not within the purview of this Board. However, it appears this award is filed correctly in his AMHRR and he has not provided a convincing reason to remove it. The applicant is advised if he still desires its removal (or to have it amended to show the correct social security number), to contact the State ARNG or the National Guard Bureau regarding this issue.
