         The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

APPLICANT REQUESTS: Correction of his DD Form 214 (Certificate of Release from Active Duty) corrected to show that he had 2 months of foreign service, prior service from 21 August 1985 to 10 November 1987 and, in effect, that he had been authorized or awarded the Reserve Components Overseas Service Ribbon, the Army Reserve Components Achievement Medal (ARCAM), the Good Conduct Medal and the Army Achievement Medal.

APPLICANT STATES: He submits letters of support from his California Army National Guard (CAARNG) section sergeant and platoon sergeant and two ARNG platoon level evaluations to support his request.

EVIDENCE OF RECORD: The applicant's military records show:

He joined the CAARNG on 21 August 1985 and completed initial active duty training as one site unit training (OSUT) from 2 January 1986 to 9 May 1986 (4 months and 8 days). On 21 October 1987, he was discharged from Headquarters and Headquarters Company, 1st Battalion, 185th Armor, CAARNG to enlist in a regular component of the Armed Forces. His National Guard Bureau (NGB) Form 22, (Report of Separation and Record of Service) lists both his Net Service This Period and Total Service as 2 years, 2 months and 1 day. It shows no prior service and lists his decorations and awards as the Army Service Ribbon.
The applicant was in the Army Reserve Delayed Entry Program from 22 October to 9 November 1987 and entered the Regular Army on 10 November 1987. He was separated, on 4 October 1988, with a general discharge due to a pattern of misconduct. His DD Form 214 lists his authorized awards as the Army Service Ribbon, the Parachute Badge and the Expert Qualification Badge with Rifle Bar.

The applicant's supporting documentation is as follows:

         A sergeant wrote that he was the applicant's section sergeant from August 1985 to October 1987 and that the applicant went through "several training cycles and was highly motivated."

A now retired first sergeant wrote that the applicant was under his command in the 4th platoon, 1st Battalion, 185th Armor from 1985 to October 1987. He reports that, in 1987, the applicant served in Korea where he cross trained as an Armor Scout and that, while in the 1st Battalion, 185th Armor, the applicant was awarded the Army Reserve Component Overseas Training Ribbon, the ARCAM and the Army Achievement Medal.

        
The 26 November 1985 local evaluation report shows that the applicant had completed 4,379 hour of training in various subjects. (This equals approximately 543 eight-hour days.) The 3 November 1987 local evaluation report shows that the applicant had completed 14,863 hour of training in various subjects. (This equals approximately 1,857 eight-hour days) Both are signed by the same, now retired, first sergeant.

Army Regulation 600-8-22 (Military Awards), indicates that the ARCAM is awarded for exemplary behavior, efficiency and fidelity while serving as a member of an Army National Guard or Army Reserve troop program unit or as an individual mobilization augmentee. Four years of consecutive qualifying service is required for each award.

The regulation also provides that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service.

Army Regulation 600-8-22 also provides that the Army Achievement Medal is awarded to any member of the armed forces of the United States, who while serving in a non-combat area on or after 1 August 1981 distinguished themselves by meritorious service or achievement. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required.

The regulation also provides that, since 11 July 1984, the Army Reserve Components Overseas Training Ribbon is awarded to members of the USAR and ARNG who complete annual training (AT) or active duty training (ADT) assignments of at least 10 consecutive days in a foreign location.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1. The applicant was not eligible to receive the ARCAM until he had completed 4 years of membership in the Reserve Components, or the Good Conduct Medal until he had completed 3 years of honorable active service. There is no substantiating evidence of record to show that the applicant was awarded the Army Achievement Medal or that he performed any overseas AT or ADT.
