THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Meritorious Service Medal (MSM) and Military Outstanding Volunteer Service Medal (MOVSM).
2. The applicant states he did not have signed copies of the award documents approving his MSM and MOVSM at the time he was issued his DD Form 214.
3. The applicant provides copies of his MSM and MOVSM award documents.
CONSIDERATION OF EVIDENCE:
1. The applicant was appointed as a commissioned officer, in the rank of second lieutenant, in the Regular Army on 28 May 2005. He was promoted to captain on 1 July 2008.
2. He served in Iraq from 16 October 2006 to 30 November 2007 and also from 7 October 2009 to 9 August 2010.
3. A DA Form 4980-12 (MSM Certificate) shows Headquarters, Fort Riley, KS, Permanent Order Number 304-010, dated 30 October 2012, awarded the applicant the MSM for meritorious service during the period 28 May 2005 to
16 October 2012.
4. A review of the applicant's Army Military Human Resource Record (AMHRR) does not show award of the MOVSM.
5. A DD Form 214 shows the applicant was honorably retired from active duty on 16 October 2012 based on permanent disability.
a. He completed 7 years, 8 months, and 3 days of net active service this period.
b. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) does not show the MSM or MOVSM.
6. In support of his request the applicant provides a copy of a DA Form 638 (Recommendations for Award) that shows the Commander, 1st Battalion, 5th Field Artillery, Fort Riley, KS, approved award of the MOVSM to the applicant for exceptionally meritorious service from 1 August 2011 to 26 June 2012.
7. Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations. It shows the MOVSM may be awarded to members of the Armed Forces of the United States and their Reserve Components who, subsequent to 31 December 1992, perform outstanding volunteer community service of a sustained, direct, and consequential nature.
a. To qualify for award of the MOVSM a service member's volunteer service must meet the following requirements: (1) be to the civilian community, to include the military family community; (2) be significant in nature and produce tangible results; (3) reflect favorably on the Military Service and the Department of Defense; and (4) be of a sustained and direct nature.
b. Approval authority for award of the MOVSM is a commander serving in the rank of lieutenant colonel or higher.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record shows:
a. permanent orders awarded the applicant the MSM; and
b. the Commander, 1st Battalion, 5th Field Artillery, Fort Riley, KS, awarded the applicant the MOVSM.
2. Therefore, he is entitled to correction of his DD Form 214 to show the above awards.

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 13 of his DD Form 214 the Meritorious Service Medal and Military Outstanding Volunteer Service Medal.
