THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, correction of his DD Form 214 (Report of Transfer or Discharge) to show the second digit of his Social Security Number (SSN) as "2."
2. The applicant states he is having trouble enrolling in the Department of Veterans Affairs Healthcare System due to the problem with his SSN.
3. The applicant provides copies of his DD Form 214 and social security card.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant served honorably in the Army of the United States from
24 November 1965 through 3 November 1967.
3. During his period of service the primary identification number utilized was the Army Service Number, not the SSN. However, the following documents did utilize or include his SSN:
* A DA Form 20 (Enlisted Qualification Record) which was audited on
25 February 1967 lists the second digit of his SSN as "2"
* A DD Form 214 which shows the second digit of his SSN as "8"
4. The social security card the applicant provided also shows the second digit of his SSN as "2."
DISCUSSION AND CONCLUSIONS:
The applicant contends the second digit of his SSN should be listed as an "2" on his DD Form 214. The available evidence is sufficient to correct the applicant's SSN to show the second digit as "2." Therefore, his DD Form 214 should be corrected to show his SSN as it is listed on his social security card.
