THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) recorded on his DD Forms 214 (Armed Forces of the United States Report of Transfer or Discharge) for the periods ending 30 August 1961 and 30 August 1967. 2. He states the DD Forms 214 show the wrong SSN. 3. He provides his social security card and his DD Forms 214 for the periods ending 30 August 1961 and 30 August 1967. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 7 December 1960, the applicant was inducted into the Army of the United States. He was assigned an Army service number (ASN) as the primary source of identification. 3. On 30 August 1961, he was discharged to immediately enlist in the Regular Army (RA), which he did the following day. Item 32 (Remarks) of the DD Form 214 issued at that time shows his SSN listed as "136-XX-XXXX." The last six digits are the same as those shown on the social security card he provides. 4. On 30 August 1967, he was discharged to immediately reenlist, which he did the following day. Item 3 (SSN) of the DD Form 214 issued at that time shows his SSN listed as "136-XX-XX27." Only the sixth and seventh digits are the same as those shown on the social security card he provides. 5. He continued his service in the RA through his retirement on 25 February 1981. The DD Form 214 issued at that time shows the same SSN as that shown on the social security card he provides. Numerous other documents in his records also show the same SSN as that shown on his social security card. 6. When the applicant entered active duty, Soldiers were identified by an ASN. The Army discontinued using the ASN as an identifier and began using the SSN on 1 July 1969. DISCUSSION AND CONCLUSIONS: The SSN shown on the applicant's social security card was recorded in his military records. It appears an administrative error resulted in the incorrect transcription of his SSN on his DD Forms 214 for the periods ending 30 August 1961 and 30 August 1967. It would be appropriate to correct these forms to show the SSN listed on the social security card he provides.
