THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his previous request for correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Army Superior Unit Award.

2.  The applicant states he is providing evidence which shows his unit was awarded the Army Superior Unit Award for the period 1 May 1984 through 
1 February 1985 and he was assigned to the unit during that time.  

3.  The applicant provides: 

* training completion certificate
* letters of commendation and appreciation
* certificate of participation
* Army Achievement Medal (AAM) Certificate

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20120004810 on 13 September 2012.

2.  The documents provided by the applicant were not discussed in the previous Record of Proceedings (ROP).  Therefore, these documents are considered new evidence which warrant consideration by the Board.
3.  He enlisted in the Regular Army on 14 May 1982 and he held military occupational specialty 11B (Infantryman).

4.  His exact period of assignment to the 1st Battalion, 3rd Infantry is unknown.

5.  He was released from active duty (REFRAD) on 13 May 1985.  His REFRAD orders, dated 18 March 1985, listed his unit of assignment as Company A, 1st Battalion, 3rd U.S. Infantry (The Old Guard).

6.  His DD Form 214 shows his last duty assignment as Company A, 1st Battalion, 3rd Infantry, (The Old Guard).  It does not reflect the Army Superior Unit Award.

7.  Department of the Army General Orders Number 9, dated 1 April 1987, awarded the 1st Battalion, 3rd Infantry, the Army Superior Unit Award for service from 1 May 1984 to 1 February 1985.

8.  He provides an AAM Certificate that shows he was awarded the AAM for exemplary service and dedication to the mission from August 1982 through May 1985 while serving as a rifleman and company armorer with Company A (Commander-in-Chief's Guard), 3rd U.S. Infantry (The Old Guard).  The AAM is listed on his DD Form 214.  He also provides a training completion certificate, a letter of commendation, and a letter of appreciation that indicate he was a member of the 3rd U.S. Infantry during the period 15 October 1982 through 30 June 1983.

DISCUSSION AND CONCLUSIONS:

1.  The evidence shows he was a member of Company A, 1st Battalion, 3rd U.S. Infantry (The Old Guard) during the period 1982-1983 and that he was still a member of this unit upon the end of his term of service on 13 May 1985.  

2.  Additionally, he was awarded the AAM for service during the period August 1982 through May 1985 while serving with Company A (Commander-in-Chief's Guard), 3rd U.S. Infantry (The Old Guard).  It is reasonable to presume he was a member of this unit during the period this unit was awarded the Army Superior Unit Award (1 May 1984 to 1 February 1985.)  Therefore, it would be appropriate to correct his DD Form 214 by adding this unit award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20120004810, dated 13 September 2012.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to his 
DD Form 214 the Army Superior Unit Award.
