THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests award of the Global War on Terrorism Service Medal (GWOTSM).
2. The applicant states according to the code of Federal regulations, Title
32, section 578.32, all service members on active duty, including Reserve Components mobilized, or National Guardsmen activated on or after
11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the GWOTSM.
3. The applicant provides a copy of his DD Form 214 (Certificate of Release or Discharge from Active Duty).
CONSIDERATION OF EVIDENCE:
1. The applicant was ordered to active duty for training from the Army National Guard (ARNG) on 11 August 2009. He completed the 19-week advanced individual training (AIT) course in military occupational specialty 31B (military police). He was released from active duty (REFRAD) on 18 December 2009 and transferred to the ARNG.
2. His DD Form 214 for the period ending 18 December 2009 does not show the GWOTSM as an authorized award.
3. Army Regulation 600-8-22 (Military Awards) states the GWOTSM is authorized for award to members of the Armed Forces of the United States who have participated in Global War on Terrorism operations outside of the areas of eligibility (AOE) designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the GWOTSM.
4. A Frequently Asked Questions document from the U. S. Army Human Resources Command, Military Awards Branch, contains examples to show Soldiers' eligibility for awards. The document states:
* Question: Are Reserve or Active Component Soldiers on active duty primarily for training authorized to be awarded the GWOTSM? What about Soldiers on Active Duty for Training (ADT) orders?
* Answer: Negative. Soldiers serving on active duty primarily for training in Initial Entry Training (IET) or Basic Training (BT), AIT, and/or for Annual Training (AT), Officer training courses, Warrant Officer training courses, and/or any training not in direct support of the GWOT operations are not authorized award of the GWOTSM.
DISCUSSION AND CONCLUSIONS:
1. Evidence shows the applicant was ordered to active duty for AIT on 11 August 2009 and he was REFRAD on 18 December 2009.
2. Since Soldiers serving on active duty primarily for training in AIT or any training not in direct support of the GWOT operations are not authorized award of the GWOTSM, there is no basis for granting his request for the GWOTSM.
