		BOARD DATE:	29 November 2012

		DOCKET NUMBER: AR20120009719

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

CONSIDERATION OF ADDITIONAL EVIDENCE:

7. On 14 May 2012, the applicant submitted a new DD Form 149 (Application for Correction of Military Record Under the Provisions of Title 10, U.S. Code, Section 1552) in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20100026036, dated 5 May 2011, wherein he stated his military occupational specialty (MOS) (interpreted to mean "related civilian occupation"), as corrected by the ABCMR, is still incorrect.

ADDITIONAL DISCUSSION AND CONCLUSIONS:

5. At the time of the decision of the ABCMR in Docket Number AR20100026036, dated 5 May 2011, it was the intent of the ABCMR to make the applicant’s record as administratively correct as it should properly have been at the time.

6. The ABCMR's decision in Docket Number AR20100026036 determined that he served as a Surgical Technician in MOS 0861. Accordingly, his corresponding "related civilian occupation" should have been corrected to read "Surgical Technician." However, due to an administrative error, it was erroneously corrected to read "Medical Technician." Therefore, it would be appropriate to further correct item 5 (Qualifications) of his DD Form 214 to show the related civilian occupation associated with his MOS was that of "Surgical Technician."

The applicant's military service records are not available to the Board for review. The applicant contends that item 5 of his 30 April 1953, DD Form 214 should be corrected because he was school trained in MOS 0861 and performed duties as a surgical technician. Records show the applicant successfully completed the Surgical Technician Course at the Medical Field Service School, Brooke Army Medical Center, Fort Sam Houston, Texas on 5 November 1948 and he was awarded MOS 0861.

The applicant's records contain a partially legible Certificate of Disability for Discharge-Report of Medical Board of Officers (WD AGO Form 40). It states, in pertinent part, that in order to award a PH there must be evidence that a member was wounded or injured as a result of enemy action. The evidence of record confirms the applicant was wounded in action in the ETO on 21 March 1945, and awarded the PH in Hospital Center, Camp Edwards GO Number 25 on 4 October 1945.

His 19 March 1953 DD Form 214 shows he completed 3 years of active military service during this period. His 11 March 1965 DD Form 214 shows he completed 6 years of active military service during this period. Although the applicant requests correction of his records to show he entered active service in May 1947 in Little Rock, AR, and was assigned to Fort Knox in May 1947 for basic training, the evidence of record shows he entered active service on 29 April 1948 in the U.S. Air Force.

According to Army Regulation 600-8-22 (Military Awards), he should have received a 10-percent increase in retired pay. Considering the duties of MOS 12A described in Army Regulation 611-201 and the associated list of related civilian occupations, it is unclear why personnel preparing the DD Form 214 would have chosen "Woodchopper." By law, to receive an increase in retired pay based on award of the Soldier's Medal, an enlisted member must have retired after 20 or more years of active...

The applicant requests correction of his WD AGO Form 53-55 (Enlisted Record and Report of Separation – Honorable Discharge) to show award of the Combat Medical Badge (CMB) instead of the listed "Medical Badge." Through no fault of his own he was not promoted on 15 August 2011, the date he was eligible in accordance with the State orders. The evidence of record shows the applicant was appointed on 15 August 2009. Since his DOR as a warrant officer one was 15 August 2009 and since he needed 2 years of time in grade for promotion to CW2, he would have been promotable on 15 August 2011.

On 30 March 2012, by letter, officials at HRC notified the applicant that there were no VA rating decision or medical records in his claim to confirm how each disability occurred. Incurring disabilities while in a theater of operations or in training exercises is not, in and of itself, sufficient to grant a military retiree CRSC. The applicant has submitted evidence to show his right shoulder and left ankle injuries are service-related.
