THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


CONSIDERATION OF ADDITIONAL EVIDENCE:

9.  On 11 April 2012, new information was received from the Defense Finance and Accounting Service (DFAS) in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20110003997, dated 22 November 2011.

10.  The evidence submitted consists of an email, dated 11 April 2012, which states:

	a.  the entry "100" in item 16 (Days Accrued Leave Paid) of the applicant's DD Form 214 (Certificate of Release or Discharge from Active Duty) is incorrect since a service member can sell only 60 days in a career in most cases.  The correct entry for item 16 of his DD Form 214 should be 24.5. 

	b.  the entry in item 1c of the Board Determination/Recommendation is incorrect because lump-sum leave is sold at the price of base pay, only.  It is not computed on full pay and allowances.   

ADDITIONAL DISCUSSION AND CONCLUSIONS:

6.  At the time of the decision of the ABCMR in Docket Number AR20110003997, dated 22 November 2011, it was the intent of the ABCMR to make the applicantÂ’s record as administratively correct as it should properly have been at the time.



7.  The ABCMR's decision in Docket Number AR20110003997 erroneously stated in:

   a.  paragraph 1b of the Board Determination/Recommendation the entry "deleting from item 16 of his DD Form 214 for the period ending 24 August 2010 the entry "10" and replacing it with the entry "124.5"; and "

	b.  paragraph 1c of the Board Determination/Recommendation the entry "paying him for 22.5 days of leave (computed based on full pay and allowances)"

8.  Per DFAS guidance:

   a.  the entry in paragraph 1b of the Board Determination/Recommendation should state "deleting from item 16 of his DD Form 214 for the period ending 
24 August 2010 the entry "100" and replacing it with the entry "24.5"; and"

   b.  the entry in paragraph 1c of the Board Determination/Recommendation should state "paying him for 22.5 days of leave."

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20110003997, dated 22 November 2011, by deleting the entry in:

   a.  paragraph 1b of the Board Determination/Recommendation and replacing it with the entry "deleting from item 16 of his DD Form 214 for the period ending 24 August 2010 the entry "100" and replacing it with the entry "24.5"; and"



   b.  paragraph 1c of the Board Determination/Recommendation and replacing it with the entry "paying him for 22.5 days of leave."
