THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests items 4a (Grade, Rate, or Rank), 4b (Pay Grade), and 12i (Effective Date of Pay Grade) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 2 September 2010 be corrected.   

2.  The applicant states:

* he is currently doing an interstate transfer and he doesn't want his rank to be an issue
* his pay grade is incorrect on his DD Form 214 for the period ending 
   2 September 2010 and other current documents
* he was promoted twice during his deployment

3.  The applicant provides:

* Defense Finance and Accounting Service (DFAS) Military Leave and Earnings Statement (check date 13 August 2010)

CONSIDERATION OF EVIDENCE:

1.  He enlisted in the Army National Guard on 1 April 1999 for a period of 8 years and on 21 November 2006 for a period of 6 years.  He was ordered to active duty on 1 October 2009 in support of Operation Iraqi Freedom.  He served in Kuwait/Iraq from 3 December 2009 to 26 July 2010.  On 2 September 2010, he was released from active duty. 
2.  Item 4a of his DD Form 214 for the period ending 2 September 2010 shows the entry "PV2" [private 2].  Item 4b shows the entry "E02."  Item 12i shows the entry "2009 05 12" [12 May 2009].

3.  Records from DFAS show his pay grades as:

* Pay grade E-3 from 11 August 2009  through 14 February 2010
* Pay grade E-4 from 15 February 2010 through 2 September 2010

DISCUSSION AND CONCLUSIONS:

The DFAS information which shows the applicant was separated in the pay grade of E-4 on 2 September 2010 is accepted as sufficient evidence on which to amend items 4a, 4b, and 12i of his DD Form 214 for the period ending 
2 September 2010.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  deleting the entry in item 4a of his DD Form 214 for the period ending 
2 September 2010 and replacing it with "SPC";

	b.  deleting the entry in item 4b and replacing it with "E4"; and



	c.  deleting the entry in item 12i and replacing it with "2010 02 15."
