THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 26 March 2009 to show all of his decorations, awards, and foreign service.

2.  The applicant states, in effect, his DD Form 214 does not reflect all of his decorations, awards and overseas service; however, his DD Forms 214 combined contains all the information.

3.  The applicant provides his:

* DD Form 214 (Report of Separation from Active Duty) for the period ending 24 September 1979 (U.S. Navy (USN))
* DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 27 April 1991 (U.S. Naval Reserve (USNR))
* National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) for the period ending 23 January 2001
* DD Form 214 for the period ending 26 March 2009

CONSIDERATION OF EVIDENCE:

1.  The applicant’s records, though somewhat incomplete, show that he was born on 9 November 1953.  He originally enlisted in the USN on 26 September 1975 and he served until he was honorably released from active duty (REFRAD) on


24 September 1979.  He was transferred to the USNR to complete his remaining service obligation.  The DD Form 214 he was issued at the time shows he served 3 years, 8 months, and 17 days of foreign and/or sea service; however, no decorations or awards are shown.  He served in the USNR until 1 October 1981.

2.  He again enlisted in the USNR on 16 August 1986 and on 8 September 1990 he was ordered to active duty in support of Operation Desert Shield/Desert Storm and deployed to Saudi Arabia from 4 November 1990 to 5 December 1990.  He served until he was honorably REFRAD on 27 April 1991.  The DD Form 214 he was issued at the time shows he served 7 months and 9 days of foreign service.  It also shows he was awarded the:

* Navy/Marine Corps Overseas Service Ribbon
* National Defense Service Medal
* Battle "E"
* Sea Service Deployment Ribbon

3.  On 16 May 1997, he enlisted in the North Carolina Army National Guard (NCARNG).  He served until he was honorably discharged on 23 January 2001.  The NGB Form 22 he was issued at the time shows the same awards as shown on his DD Form 214 for the period ending 27 April 1991.

4.  On 16 May 2001, he enlisted in the U.S. Army Reserve (USAR) and on 
7 December 2003 he was ordered to active duty in support of Operation Iraqi Freedom.  He deployed to Iraq from 20 February 2004 - 25 February 2005 for a period of 1 year and 6 days.

5.  On 26 March 2009, he was honorably REFRAD at Fort Bliss, TX and he was returned to his USAR unit in Arizona.  The DD Form 214 he was issued at the time shows that he served 1 year and 6 days of foreign service.  It also shows award of the:

* Army Commendation Medal
* National Defense Service Medal (2d Award)
* Global War on Terrorism Expeditionary Medal
* Armed Forces Reserve Medal with "M" Device
* Noncommissioned Officer Professional Development Ribbon
* Army Service Ribbon
* Sea Service Deployment Ribbon
* Driver and Mechanic Badge with Driver - W Bar


6.  Army Regulation 600-8-22 (Military Awards) states the Global War on Terrorism Service Medal (GWOTSM) is authorized for award to members of the Armed Forces of the United States who have participated in Global War on Terrorism operations outside of the areas of eligibility (AOE) designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal.  All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined having served 
30 consecutive or 60 nonconsecutive days are authorized the GWOTSM.

7.  Army Regulation 635-5 (Separation Documents) serves as the authority for the preparation of the DD Form 214.  It provides that for:

* block 12f, enter only foreign service performed during the period covered by the DD Form 214
* block 13, enter awards and decorations for all periods of service

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s contention that all of his foreign service should be reflected on his DD Form 214 has been noted and found to lack merit.  Each of his separation documents appropriately reflect the period of foreign and/or sea service performed during the period covered by the report.  There is no provision to combine all periods of foreign and/or sea service onto a single separation document.  Accordingly, there is no basis for granting this portion of the applicant's request.

2.  Records show he was awarded the Battle "E" Ribbon and the Navy/Marine Corps Overseas Service Medal.  Additionally, he served during a qualifying period for entitlement to the Global War on Terrorism Service Medal (GWOTSM).  Therefore, his DD Form for the period ending 26 March 2009 should be corrected to show these awards.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to his DD Form 214 for the period ending 26 March 2009 the:

* Global War on Terrorism Service Medal
* Battle "E" Ribbon
* Navy/Marine Corps Overseas Service Medal

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to adding all periods of foreign service to his DD Form 214 for the period ending 26 March 1991.

3.  The Board wants the applicant and all others to know that the sacrifices he made in service to the United States during the Global War on Terrorism are deeply appreciated.  The applicant and all Americans should be justifiably proud of his service in arms.
