THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that the Army Good Conduct Medal
(4th Award); the Non-Commissioned Officer Professional Development Ribbon
(2nd Award); the Overseas Service Ribbon (3rd Award) for Germany, Desert
Shield, and Desert Storm; the Presidential Unit Citation; the Combat
Infantryman Badge; the NATO Medal (2nd Award) for Bosnia and Kosovo; the
German Armed Forces Military Proficiency Badge in Gold; the Yugoslavia
Campaign Medal; the Kosovo Campaign Medal; the Global War on Terrorism
Expeditionary Medal; and the Global War on Terrorism Service Medal be
awarded to him and that these awards be added to the DD Form 214
(Certificate of Release or Discharge from Active Duty) dated 20 December
2003.
2. The applicant states, in effect, these awards are not shown on his DD
Form 214 due to poor record keeping.
3. The applicant provides copies of his DA Form 4187 (Personnel Action);
his DD Form 1351-2 (Travel Voucher or Subvoucher); a memorandum from
Department of the Army (DA), Headquarters, 1-325th Airborne Infantry
Regiment, 82nd Airborne Division, Fort Bragg, North Carolina; his orders
for the Good Conduct Medal Clasp (3rd Award); his DA Form 1059 (Service
School Academic Evaluation Report); his Service Member Deployment History
Outprocessing Verification; his DD Forms 214; the Global War on Terrorism
Expeditionary Medal, and the Global War on Terrorism Service Medal
implementation instructions; and an article titled, "Battle Honors,"
in support of his application.
CONSIDERATION OF EVIDENCE:
1. The applicant's military records show he enlisted in the Regular Army
on 20 March 1985, with prior enlisted service. He was discharged from
active duty effective 17 March 1989, at the expiration of his term of
service.
2. The applicant was ordered to active duty in support of Operation Desert
Shield/Desert Storm on 17 November 1990. He served in Saudi Arabia with
the 639th Transportation Company in military occupational specialty (MOS)
88M, Motor Transport Operator. He was released from active duty effective
4 September 1991 and transferred to a Reserve unit.
3. The DD Form 214 issued to him on 4 September 1991, lists the following
awards: the Army Service Ribbon; the National Defense Service Medal; the
Army Lapel Button; the Expert Marksmanship Qualification Badge, with
Automatic Rifle Bar (M-16 Rifle); the Southwest Asia Service Medal, with
two bronze service stars; the Driver and Mechanic Badge, with Wheeled
Vehicle Driver Bar; and the Army Good Conduct Medal.
4. The applicant was honorably discharged from the US Army Reserve on
26 October 1993.
5. The applicant enlisted in the Tennessee Army National Guard (TNARNG)
effective 31 August 1995. He was discharged from the TNARNG on 18
November 1996, under the provisions of National Guard Regulation 600-200,
paragraph 8-26b, for enlistment in any component of the Armed Forces.
6. The applicant enlisted in the Regular Army on 19 November 1996.
7. The DA Form 4187 the applicant submitted shows he was awarded the
German Armed Forces Military Proficiency Badge, in Gold, on 3 April 1998,
and was seeking the authority to accept and wear this foreign award. A
Headquarters, 1st Armored Division, Memorandum, Subject: Foreign Awards,
dated 9 December 1998, shows that he and other Soldiers were authorized
to accept and wear the German Army Marksmanship Badge (Schutzenschnur)
and the Armed Forces Proficiency Badge, in Gold (Leitungsabzeichen).
8. The applicant submitted a copy of a DD Form 1351-2, which he submitted
to his servicing finance office on 14 October 1998, shows he served in
Bosnia from 7 June to 1 October 1998.
9. Order 288-005, dated 15 October 1999, shows he was awarded the Army
Good Conduct Medal (2nd Award), for exemplary behavior, efficiency and
fidelity in the Active Federal Military Service, for the period 19 November
1996 to 18 November 1999.
10. In a 1st Battalion, 325th Airborne Infantry Regiment, Memorandum,
Subject: NATO Medal and Kosovo Campaign Medal, dated 8 March 2001, the
applicant was authorized award of the NATO Medal and the Kosovo Campaign
Medal for being a bonafide member of the task force in support of
Operation Joint Guardian in Kosovo for the period 24 January 2001 to 15
June 2001.
11. Permanent Orders Number 081-55, prepared by the 82d Soldier Support
Battalion (Airborne), 82d Airborne Division, dated 22 March 2002, shows the
applicant was awarded the Good Conduct Medal Clasp (3rd Award) for
exemplary behavior, efficiency, and fidelity while serving in the United
States Army for the period 14 August 1997 to 13 August 2000.
12. The DA Forms 1059 the applicant submitted in support of his request
shows he completed the Basic Non-Commissioned Officers Course, Phase I, on
5 June 2002, and Phase II on 11 July 2002.
13. The applicant's DD Form 214, with a discharge date of 20 December
2003, shows he completed training and served in MOS 11B, as an
infantryman, with the 325th Airborne Infantry Regiment and was deployed
to Southwest Asia in support of Operation Enduring Freedom (Kuwait) from
15 February 2003 to 15 April 2003.
14. The 3rd Infantry Division (Mechanized), and its supporting units,
which included the applicant's unit, received approval for award of the
Presidential Unit Citation (PUC) for the period 19 March 2003 to 1 May
2003. Approval of this award was announced in a Memorandum, Subject:
Recommendation for Award of the Presidential Unit Citation, by the US
Total Army Personnel Command [now the US Army Human Resources Command], on
10 September 2003. The applicant's unit, the 1st Battalion, 325th
Airborne Infantry Regiment, a supporting unit of the 3rd Infantry Division
(Mechanized), was recognized for its service for the period 28 April
through 1 May 2003.
15. Paragraph 5, of the memorandum referenced in the paragraph above
states, "This correspondence will serve as authorization for the award
of the PUC to be annotated to military personnel records
pending announcement in Department of the Army General Orders."
16. The applicant was honorably discharged from active duty at the
completion of required active service, in pay grade E-6, on 20 December
2003, and was transferred to a Reserve unit.
17. The DD Form 214 issued to him lists the following awards: the Army
Commendation Medal; the Army Achievement Medal (2nd Award); the
Meritorious Unit Commendation; the Army Good Conduct Medal (2nd Award);
the Army Reserve Components Achievement Medal; the National Defense
Service Medal (2nd Award); the Armed Forces Expeditionary Medal; the
Southwest Asia Service
Medal, with 3 Bronze Service Stars; the Armed Forces Service Medal; the
Non-Commissioned Officer's Professional Development Ribbon; the Army
Service Ribbon; the Overseas Service Ribbon (2nd Award); the North
Atlantic Treaty Organization Medal; the Kuwait Liberation Medal [awarded
by the Kingdom of Saudi Arabia]; the Kuwait Liberation Medal with K
[awarded by the Government of Kuwait]; the Expert Marksmanship
Qualification Badge with Rifle Bar; the Driver and Mechanic Badge with
Driver-W Bar; and the Gold German Army Marksmanship Badge.
18. The applicant reenlisted in the TNARNG, in pay grade E-6, on 30
September 2003. He was subsequently discharged from the TNARNG, for
misconduct, in pay grade E-2, on 14 June 2004, and was transferred to the
USAR Control Group (Reinforcement).
19. The applicant submits a copy of an article titled, "Battle Honors"
that states the 325th Airborne Infantry Regiment was awarded the PUC for
gallantry during battle in Iraq in April 2003. The article also states
that all three of the 325th Airborne Regiment's infantry battalions saw
action in As Samawah, Iraq, securing key bridges and supply lines during
four days of fighting in April 2003.
20. Army Regulation 600-8-22 (Military Awards) provides that the Army Good
Conduct Medal is awarded to individuals who distinguish themselves by their
conduct, efficiency and fidelity during a qualifying period of active duty
enlisted service. This period is 3 years except in those cases when the
period for the first award ends with the termination of a period of Federal
military service. Although there is no automatic entitlement to the Good
Conduct Medal, disqualification must be justified.
21. Army Regulation 600-8-22 shows that the Non Commissioned Officer
Professional Development Ribbon was established by the Secretary of the
Army on 10 April 1981. It is awarded to members of Active Army, Army
National Guard, and U.S. Army Reserve Soldiers for successful completion of
designated NCO professional development courses.
22. Army Regulation 600-8-22 shows that the Overseas Service Ribbon was
established by the Secretary of the Army on 10 April 1981. The regulation
states, in pertinent part, that effective 1 August 1981, all members of the
Active Army, Army National Guard, and Army Reserve in an active Reserve
status are eligible for the award for successful completion of overseas
tours. The award may be awarded retroactively to those personnel who were
credited with a
normal overseas tour completion before 1 August 1981 provided they had an
Active Army status on or after 1 August 1981 and the overseas service is
not recognized with another U.S. service medal. Numerals are used to
denote the second and subsequent awards of the Overseas Service Ribbon.
23. Army Regulation 600-8-22 provides, in pertinent part, that the
Presidential Unit Citation (known as the Distinguished Unit Citation until
3 November 1966) is awarded for extraordinary heroism in action. A unit
must display such gallantry, determination and esprit de corps in
accomplishing its mission as would warrant award of the Distinguished
Service Cross to an individual.
24. Army Regulation 600-8-22 prescribes Army policy and procedures
concerning awards. Paragraph 8-6, in this regulation, provides for award
of the Combat Infantryman Badge. Paragraph 8-6.k. specifies that for the
Persian Gulf War (Operation Desert Shield/Desert Storm) individuals must
have met the criteria in paragraphs 8-6.b and c to be awarded the Combat
Infantryman Badge during the period 17 January 1991 to 11 April 1991.
These paragraphs state that there are basically three requirements for
award of the Combat Infantryman Badge. The Soldier must be an infantryman
satisfactorily performing infantry duties, he must be assigned to an
infantry unit during such time as the unit is engaged in active ground
combat, and he must actively participate in such ground combat. Specific
requirements state, in effect, that an Army enlisted Soldier must have an
infantry or special forces specialty, satisfactorily performed duty while
assigned or attached as a member of an infantry, ranger or special forces
unit of brigade, regimental, or smaller size during any period such unit
was engaged in active ground combat. A recipient must be personally
present and under hostile fire while serving in an assigned infantry or
special forces primary duty, in a unit actively engaged in ground combat
with the enemy.
25. The NATO Medal was authorized by the Secretary General of the North
Atlantic Treaty Organization for specific NATO operations. The Secretary
of Defense may approve acceptance and wear by United States service
members who meet the criteria specified by the Secretary General of NATO.
Acceptance of the NATO Medal has been approved for U.S. military personnel
who serve under NATO command or operational control in direct support of
NATO operations in the former Republic of Yugoslavia from 1 July 1992
through a date to be determined.
26. To qualify for award of the NATO Medal, US military personnel must
complete the qualifying period of service. Qualifying periods of service
for the NATO Medal are either 30 days (continuous or accumulated) in the
territory and airspace of the former Republic of Yugoslavia and the
Adriatic sea, or 90 days (continuous or accumulated) in the area or
operations outside the former Republic of Yugoslavia and Adriatic sea,
between 1 July 1992 and a future date to be determined. To be eligible for
award of the NATO Medal, US military personnel must serve or have served
under one of the following command structures: (1) under direct NATO
command in Headquarters AFSOUTH, Headquarters NAVSOUTH, Headquarters
AIRSOUTH, or Headquarters SATAF, and in direct support of NATO operations
in the former Republic of Yugoslavia; (2) under direct NATO command in
other installations, within the area of operations and in direct support of
NATO operations, as designated by SACEUR; (3) under direct NATO operational
command in the NATO airborne early warning force, or in ships assigned to
operations maritime monitor, maritime guard or sharp guard; (4) under
direct NATO operational control in operation deny flight, in ships and
aircraft assigned to operations maritime monitor, maritime guard or sharp
guard, or as NATO liaison officers. Because the commencement date of NATO
medal eligibility for operations concerning the former Republic of
Yugoslavia is 1 July 1992, NATO has developed two distinct sets of
instructions for identifying eligible individuals—transitionary
instructions for the period 1 July 1992 through 30 November 1995, and
permanent instructions for the period from 1 December 1995 through the
termination date of the award.
27. Award of the Kosovo Campaign Medal and the NATO Medal for Kosovo
service are based on proof of service in support of specific operations
beginning in March 1999 operations in the specified area of operations.
To be eligible for award of the Kosovo Campaign Medal an individual must
be in a unit participating in an operation for 30 consecutive days or 60
nonconsecutive and/or meet other established criteria or directly
supporting the following operations: Operation Allied Force (24 March
1999 through 10 June 1999); Operation Joint Guardian (11 June 1999
through a date to be determined); Operation Allied Harbour (4 April 1999
through 1 September 1999); Operation Sustain Hope/Shining Hope (4 April
1999 through 10 July 1999); Operation Noble Anvil (24 March 1999 through
20 July 1999); or Kosovo Task Forces Hawk (5 April 1999 through 24 June
1999); Saber (31 March 1999 through 8 July 1999); Falcon (11 June 1999
through a date to be determined), coinciding with Joint Guardian; or
Hunter within areas of operation for the Kosovo Air Campaign and/or the
Kosovo Defense Campaign.
28. Army Regulation 600-8-22 provides that the acceptance and wearing of
foreign decorations and badges (including the German Armed Forces Military
Proficiency Badge and the German Marksmanship Badges) may be approved
by authorized approval authorities for wear by U.S. military personnel.
Foreign qualification and special skill badges may be accepted if awarded
in recognition of the criteria as established by the foreign government
concerned. Only those badges which are awarded in recognition of military
activities and by the military department of the host country are
authorized for acceptance and permanent wear. The regulation specifically
prohibits honorary badges from being authorized for wear or entry in
official military records.
29. Initial award of the Global War on Terrorism Expeditionary Medal is
limited to Soldiers deployed abroad in Operations Enduring Freedom and
Iraqi Freedom in the following Department of Defense designated specific
geographic areas of eligibility: Afghanistan, Bahrain, Bulgaria (Bourgas),
Crete, Cyprus, Diego Garcia, Djibouti, Egypt, Eritrea, Ethiopia, Iran,
Iraq, Israel, Jordan, Kazakhstan,
Kenya, Kuwait, Kyrgyzstan, Lebanon, Pakistan, Philippines, Qatar, Romania
(Constantan), Saudi Arabia, Somalia, Syria, Tajikistan, Turkey (east of 35
degrees east latitude), Turkmenistan, United Arab Emirates, Uzbekistan,
Yemen, that portion of the Arabian Sea north of 10 degrees north latitude
and west of 68 degrees longitude, Bab El Mandeb, Gulf of Aden, Gulf of
Aqaba, Gulf of Oman, Gulf of Suez, that portion of the Mediterranean Sea
east of 28 degrees east longitude, Persian Gulf, Red Sea, Strait of Hormuz,
and Suez Canal. To be eligible for the Global War on Terrorism
Expeditionary Medal a Soldier must be assigned, attached or mobilized to a
unit participating in designated operations for 30 consecutive days or 60
nonconsecutive days.
30. Award of the Global War on Terrorism Service Medal is authorized to
Soldiers who have participated in or served in support of Global War on
Terrorism operations outside of the designated area of operations as
outlined in the paragraph above. Initial award of the Global War on
Terrorism Service Medal will be limited to airport security operations
(from 27 September 2001 through 31 May 2002) and Soldiers who supported
Operations Noble Eagle, Enduring Freedom, and Iraqi Freedom. As with the
Global War on Terrorism Expeditionary Medal, a Soldier must have served
30 consecutive, or 60 nonconsecutive days. HRC Awards Branch personnel
have advised that the Global War on Terrorism Service Medal has been
awarded, and will continue to be awarded, to all Army personnel who serve
on active duty for 30 consecutive days, or more, regardless of where they
serve (the same criteria as the National Defense Service Medal).
31. Headquarters, U.S. Army Human Resources Command (HRC) message, dated
17 March 2004, announced implementing instructions for the Global War on
Terrorism Expeditionary Medal and the Global War on Terrorism Service
Medal. The message states, in pertinent part, that these medals will be
awarded to recognize members of the armed forces of the United States
serving in or in support of global war on terrorism operations on or after
11 September 2001, to a date to be determined.
32. In his application, the applicant requested award of the Yugoslavia
Campaign Medal. Service in the former Republic of Yugoslavia is
recognized through award of the NATO Medal. The period during which
recognition can be extended for operations related to the former Republic
of Yugoslavia, according to Army Regulation 600-8-22, is from 14 November
1995 to a date to be determined. Review of the Table of Contents for
this regulation fails to identify a specific award with the title,
Yugoslavia Campaign Medal.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record shows the applicant was awarded the Good Conduct
Medal. This award is shown on the applicant's DD Form 214 he was provided
on his release from active duty on 4 September 1991.
2. The applicant was awarded the Good Conduct Medal (2d Award) for the
period 19 November 1996 to 18 November 1999. He was awarded the Good
Conduct Medal (3rd Award) for the period 14 August 1997 to 13 August 2000.
The period established for award of the Good Conduct Medal (3d Award) is
incorrect. The periods for award of the Good Conduct Medal cannot overlap
one another. Given that he was awarded the Good Conduct Medal, (3d Award),
albeit for the incorrect period of time, the period for this award should
be amended to read, from 19 November 1999 through 18 November 2002.
3. The next period of eligibility for award of the Good Conduct Medal,
in this case the Good Conduct Medal (4th Award), would have extended from
19 November 2002 through 18 November 2005, but because the applicant was
discharged from the Regular Army on 20 December 2003, he did not complete
this qualifying period of service and he is therefore not eligible for
award of the Good Conduct Medal, (4th Award).
4. The applicant's DD Form 214, with a discharge date of 17 March 1989,
shows he completed 2 years, 5 months and 2 days service in the US Army
Europe prior to his discharge date. He met the criteria for award of the
Overseas Service Ribbon and is therefore entitled to award of the Overseas
Service Ribbon for this service.
5. When ordered to active duty and he deployed to Southwest Asia in
support of Operation Desert Shield/Desert Storm, the applicant was
awarded other service medals to recognize this service. The regulatory
guidance in AR 600-8-22 is clear; the Overseas Service Ribbon is not
awarded if another US award was awarded to recognize the service. In
addition, the applicant was not assigned to support Operation Desert
Shield/Desert Storm on a permanent change of station in accordance with
Army Regulation 614-30. He was deployed on a temporary duty basis and is
therefore not entitled to award of the Overseas Service Ribbon for this
service.
6. It is apparent the applicant was serving in Germany when his unit was
deployed in support of the military mission in Kosovo. The applicant is
therefore entitled to award of the Overseas Service Ribbon for his service
in Germany but not in Kosovo since his service was recognized with another
US service medal for that service. The currently shown entry on the
applicant's DD Form 214, "Overseas Service Ribbon (2d Award)" is the
correct number of awards to which he is entitled and he is therefore not
entitled to a third award of the Overseas Service Ribbon.
7. The applicant's unit was awarded the PUC for the period 28 April
through 1 May 2003 while serving in Iraq. He is therefore entitled to
award of the PUC and to have it added to his DD Form 214.
8. The applicant's contention that he should be awarded the Combat
Infantryman Badge and that it should be added to his DD Form 214 has been
noted. To be entitled to award of the Combat Infantryman Badge, the
evidence must show that a Soldier held and served in an infantry MOS while
assigned to an infantry unit of brigade, regimental, or smaller size, and
must have served in active ground combat while assigned to this infantry
unit. There is no evidence, and the applicant has provided none to show he
was personally present and under hostile fire while serving in his assigned
infantry primary duty, in a unit
actively engaged in ground combat with the enemy. The applicant's DD Form
214 (Item 18. (Remarks), specifically shows his service was related to:
"Service in Operation Enduring Freedom (Kuwait)."
9. Based on the available evidence, the applicant is not entitled to award
of the Combat Infantryman Badge and to have it added to his DD Form 214.
10. The evidence shows the applicant applied for and received
authorization to accept and wear the German Armed Forces Military
Proficiency Badge, in Gold, and the German Marksmanship Badge, in Gold.
The German Marksmanship Badge, in Gold, is already shown on the applicant's
DD Form 214, with an effective date of 20 December 2003. He is entitled to
have the German Armed Forces Military Proficiency Badge, in Gold, added to
his DD Form 214.
11. The applicant served in Kosovo and in Yugoslavia during the qualifying
periods for award of the NATO Medal. The NATO Medal is already shown on
the applicant's DD Form 214 with an effective date of 20 December 2003.
12. The Yugoslavia Campaign Medal the applicant requested he be awarded
and added to his DD Form 214 is not recognized as an official Army award.
The Armed Forces Expeditionary Medal was awarded to the applicant for his
service in the former Republic of Yugoslavia and this award already appears
on the applicant's DD Form 214, with an effective date of 30 December 2003.
13. Based on his participation in support of Operation Enduring Freedom he
is also entitled to award of the Global War on Terrorism Expeditionary
Medal and the Global War on Terrorism Service Medal and to have these
awards added to his DD Form 214 with an effective date of 20 December 2003.
14. The evidence shows that the applicant was awarded the Non Commissioned
Officer Professional Development Ribbon for his completion of the Basic Non-
Commissioned Officers Course, Phase I and Phase II in 2002 and this award
is already shown on his DD Form 214, dated 20 December 2003; however, it is
not shown correctly. He is not entitled to a second Non-Commissioned
Officer Professional Development Ribbon but he is entitled to an
appropriate correction to show the level of his professional development.
15. In view of the foregoing, the applicant’s records should be corrected
as shown below.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief. As a result, the Board
recommends that all Department of the Army records of the individual
concerned be corrected by:
a. deleting the Noncommissioned Officer Professional Development
Ribbon from the applicant's DD Form 214;
b. awarding the applicant the Noncommissioned Officer Professional
Development Ribbon, with Numeral 2, to denote his level of professional
development and adding this award to his DD Form 214;
c. awarding the applicant the Presidential Unit Citation and adding
this unit award to his DD Form 214;
d. adding the already-awarded German Armed Forces Military
Proficiency Badge, in Gold, to the applicant's DD Form 214; and
e. awarding the applicant the Kosovo Campaign Medal, the Global War
on Terrorism Service Medal and the Global War on Terrorism Expeditionary
Medal and adding these awards to his DD Form 214.
f. correcting Permanent Orders Number 081-55, prepared by the 82d
Soldier Support Battalion (Airborne), 82d Airborne Division, on 22 March
2002, to show the applicant was awarded the Good Conduct Medal Clasp (3rd
Award) for the period 19 November 1999 through 18 November 2002, as opposed
to the currently shown incorrect period, "14 August 1997 to 13 August
2000";
2. The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief. As a result,
the Board recommends denial of so much of the application that pertains to:
a. awarding a second Non-Commissioned Officer Professional
Development Ribbon to the applicant and adding it to his DD Form 214;
b. awarding the applicant the Good Conduct Medal (4th Award) and
adding it to his DD Form 214;
c. awarding the applicant any additional award(s) of the Overseas
Service Ribbon to the applicant and their addition to his DD Form 214;
d. awarding the applicant the Combat Infantryman Badge and its
addition to his DD Form 214;
e. awarding the applicant any additional award(s) of the NATO Medal
for his service in Kosovo or in the former Republic of Yugoslavia and their
addition to his DD Form 214; and
f. awarding the applicant the non-existent Yugoslavia Campaign Medal
and its addition to his DD Form 214.
