      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of
Release or Discharge from Active Duty) to show Foreign Service in Kuwait.

2.  The applicant states, in effect, that he was deployed to Kuwait on two
different occasions and his DD Form 214 does not show his deployment dates.


3.  The applicant provides a DD Form 214 with the ending period 28 October
2002; Headquarters, 3rd Battalion, 8th Cavalry, Permanent Orders 206-28,
dated 25 July 2001; and Headquarters, 3rd Battalion, 8th Cavalry, Permanent
Orders 80-208, dated 21 March 2002.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 30 September 1999 and
successfully completed basic training and advanced individual training.  He
was awarded military occupational specialty 19K (Armor Crewman).

2.  The applicant was deployed to Kuwait in support of Operation Desert
Spring.  He arrived in Kuwait assigned to A Company, 3rd Battalion, 8th
Cavalry on 18 April 2001 and departed Kuwait on about 15 August 2001.  His
unit was redeployed back to Kuwait in support of Operation Enduring Freedom
on 14 November 2001 and departed Kuwait on 4 April 2002.

3.  The applicant was honorably separated from active duty on 28 October
2002. His DD Form 214 shows he was awarded the National Defense Service
Medal and the Army Service Ribbon.  Item 12f (Foreign Service) shows the
entry "0000 00 00."

4.  Headquarters, 3rd Battalion, 8th Cavalry, Permanent Orders 206-28,
dated 25 July 2001 shows the applicant was awarded the Army Achievement
Medal for the period 18 April 2001 through 15 August 2001 while deployed to
Operation Desert Spring.

5.  Headquarters, 3rd Battalion, 8th Cavalry, Permanent Orders 206-28,
dated 21 March 2002 shows the applicant was awarded the Army Achievement
Medal for the period 14 November 2001 through 4 April 2002 while deployed
to Operation Enduring Freedom.

6.  The applicant's records do not show award of the Global War on
Terrorism Expeditionary Medal (GWOTEM) or the Global War on Terrorism
Service Medal (GWOTSM).
7.  Executive Order 13289 dated 12 March 2003 established the Global War on
Terrorism Expeditionary Medal and the Global War on Terrorism Service Medal
(GWOTSM).  The GWOTEM is authorized to be awarded to Soldiers who deploy
abroad in designated areas (to include Iraq) for service in global war on
terrorism operations on or after 11 September 2001 to a date to be
determined.  The GWOTSM is authorized to be awarded to Soldiers who have
participated in or served in support of global war on terrorism operations
outside the designated area of eligibility for the GWOTEM.  All Soldiers on
active duty on or after 11 September 2001 to a date to be determined having
served 30 consecutive days or 60 nonconsecutive days are authorized the
GWOTSM.

8.  The Human Resources Command Message (Date Time Group 17 March 2004)
limited initial award of the Global War on Terrorism Expeditionary Medal to
Soldiers who deployed abroad in Operations Enduring Freedom and Iraqi
Freedom in the following areas of eligibility (AOE):  Afghanistan, Bahrain,
Bulgaria (Bourgas), Crete, Cyprus, Diego Garcia, Djibouti, Egypt, Eritrea,
Ethiopia, Iran, Iraq, Israel, Jordan, Kazakhstan, Kenya, Kuwait,
Kyrgyzstan, Lebanon, Oman, Pakistan, Philippines, Qatar, Romania
(Constanta), Saudi Arabia, Somalia, Syria, Tajikistan, Turkey (east of 35
east degrees east latitude), Turkmenistan, United Arab Emirates,
Uzbekistan, Yemen, that portion of the Arabian Sea north of 10 degrees
north latitude and west of 68 degrees longitude, Bab El Mandeb, Gulf of
Aden, Gulf of Aqaba, Gulf of Oman, Gulf of Suez, that portion of the
Mediterranean Sea east of 28 degrees east longitude, Persian Gulf, Red Sea,
Strait of Hormuz, and Suez Canal.

9.  Army Regulation 635-5 (Separation Documents) prescribes the separation
documents prepared for Soldiers upon retirement, discharge, or release from
active military service or control of the Army.  It establishes
standardized preparation of the DD Form 214.  For item 12f (Foreign
Service) it states that, from the Enlisted Record Brief/Officer Record
Brief, enter the total amount of foreign service completed during the
period covered in block 12c.

10.  Army Regulation 635-5 states, in item 18 (Remarks) for an active duty
Soldier deployed with his or her unit during their continuous period of
active service, enter statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM
(inclusive dates for example, YYYYMMDD - YYYYMMDD)."

DISCUSSION AND CONCLUSIONS:

1.  Evidence of record shows that the applicant deployed to the Persian
Gulf and served in Kuwait for the periods 18 April 2001 through 15 August
2001 and 14 November 2001 through 4 April 2002.  Therefore, his DD Form 214
should be amended to add "0000" years, "08" months, and "18" days in item
12f and to add "Service in Kuwait from 18 April 2001 through 15 August 2001
and 14 November 2001 through 4 April 2002" in item 18.

2.  Evidence of record shows the applicant was awarded the Army Achievement
Medal (1st Oak Leaf Cluster).  He met the eligibility criteria for award of
the GWOTEM and the GWOTSM.  These awards should be added to his DD Form
214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
amending his DD Form 214:

      a.  in item 13 to add the Army Achievement Medal (1st Oak Leaf
Cluster), the Global War on Terrorism Expeditionary Medal, and the Global
War on Terrorism Service Medal;

      b.  in item 12f to read "0000" years, "08" months, and "18" days; and


      c.  in item 18 to add "Service in Kuwait from 18 April 2001 through
15 August 2001 and 14 November 2001 through 4 April 2002."
