THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of the dates of his first deployment to Afghanistan shown in item 18 (Remarks) of his DD Form 214 (Certificate of Release or Discharge from Active Duty).

2.  The applicant states the beginning date of the deployment was 25 November 2007 and not 25 March 2007 as indicated on the DD Form 214 as evidenced by the fact he did not enter active duty during that period until 4 October 2007.

3.  The applicant provides his DD Form 214 in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant's record shows that after serving in the Army National Guard from 23 July 1997 through 22 July 2003 and the U.S. Army Reserve from 23 July 2003 through 22 July 2005, the applicant enlisted in the Regular Army on 4 October 2007.

2.  On 3 October 2011, the applicant was honorably discharged in the rank of specialist/E-4 after completing 4 years of active military service during this period and a total of 5 years, 3 months, and 28 days of active military service.

3.  The DD Form 214 issued to the applicant upon his discharge on 3 October 2011 documents no overseas service in item 12f (Foreign Service).

4.  Item 18 of his DD Form 214 shows the applicant was deployed to both Afghanistan and Iraq during the period covered by the DD Form 214.  The dates of deployment to Afghanistan are listed as 25 March 2007 through 30 April 2008 and the dates of deployment to Iraq are listed as 12 July 2010 through 11 July 2011.

5.  During the processing of this case, a review of the applicant's Defense Finance and Accounting Service (DFAS) record shows he received hostile fire pay/imminent danger pay for his first deployment from 20 November 2007 through 30 April 2008, a period of 5 months and 11 days.

6.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army.  It also establishes standardized policy for preparing and distributing the DD Form 214.  Chapter 2 contains item-by-item instructions for preparation of the DD Form 214.  The instructions for item 12f state to add all overseas service completed during the period covered by the DD Form 214.  The instructions for item 18 state that for an active duty Soldier deployed with his or her unit during the period covered by the DD Form 214, the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)" will be entered.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's request that his DD Form 214 show the correct dates of his deployment to Afghanistan has been carefully considered and found to have merit.

2.  The evidence of record confirms the applicant did not enter active duty until 4 October 2007.  As result he could not have deployed to Afghanistan in March 2007 as is indicated in item 18 of his DD Form 214.  As a result, it would be appropriate to correct the beginning date of his deployment to Afghanistan to show 20 November 2007 as indicated in the DFAS record.

3.  In addition, it would be appropriate to document the total overseas service he accrued during his Afghanistan and Iraq deployments in item 12f of the DD Form 214 by deleting the current entry and replacing it with the entry "0001  05  11."

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the current entry in item 12f of his DD Form 214 and replacing it with the entry "0001  05  11" and by amending the Afghanistan deployment entry in item 18 of his DD Form 214 by deleting the beginning date listed and replacing it with the beginning date "20071120."
