IN THE CASE OF:
BOARD DATE: 17 April 2012
DOCKET NUMBER: AR20110019787
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests items 12a (Date Entered Active Duty This Period) and 12h (Initial Entry Training) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 16 September 2011 be changed.
2. The applicant states:
* He shipped to Fort Sill, OK for in-processing on 7 February 2011
* The entry in item 12h of his DD Form 214 must state 8 April 2011
3. The applicant provides:
* Initial active duty orders, dated 2 February 2011
* Orders, dated 3 March 2011, 31 March 2011, and 8 April 2011
* DD Form 214 for the period ending 16 September 2011
CONSIDERATION OF EVIDENCE:
1. The applicant was ordered to active duty for training from the U.S. Army Reserve on 7 February 2011. He completed his training and was awarded military occupational specialty 91B (wheeled vehicle mechanic). He was released from active duty on 16 September 2011.
2. His DD Form 214 for the period ending 16 September 2011 shows in:
* item 12a the entry "2000 02 07" (7 February 2000)
* item 12b (Separation Date This Period) the entry "2011 09 16" (16 September 2011)
* item 12c (Net Active Service This Period) that he completed 7 months and 10 days
* item 12h the entry "0011 07 10" (11 years, 7 months, and 10 days)
3. He provided orders, dated 8 April 2011, which show he was assigned to Fort Jackson, SC for basic combat training (BCT) effective 8 April 2011.
4. Records from the Defense Finance and Accounting Service (DFAS) confirm he entered active duty on 7 February 2011.
5. Department of Defense Instruction 1336.01 (Certificate of Release or Discharge from Active Duty (DD Form 214/5 Series)) states initial entry training includes BCT and advanced individual training (AIT) for Army Soldiers. This service time is shown in item 12h of the DD Form 214.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends he entered active duty on 7 February 2011 and item 12a of his DD Form 214 for the period ending 16 September 2011 is incorrect.
2. DFAS records which confirm he entered active duty on 7 February 2011 are accepted as sufficient evidence on which to amend item 12a of his DD Form 214 for the period ending 16 September 2011 to show he entered active duty on
7 February 2011.
3. He contends item 12h of his DD Form 214 for the period ending
16 September 2011 must show 8 April 2011. However, the governing regulation requires a period of time not a date. Evidence shows he entered BCT on 8 April 2011 and he was released from active duty for training on 16 September 2011, a total of 5 months and 9 days. Therefore, it would be appropriate to amend item 12h of this DD Form 214 to show he completed 5 months and 9 days of initial entry training.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
___X____ ___X____ ___X___ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. deleting the entry in item 12a of his DD Form 214 for the period ending
16 September 2011 and adding the entry "2011 02 07"; and
b. deleting the entry in item 12h of this DD Form 214 and adding the entry "0000 05 09."
2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to amending item 12h of his
DD Form 214 for the period ending 16 September 2011 to show 8 April 2011.
