THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his military records to add three awards of the Army Good Conduct Medal. [The applicant may, in fact, mean the Army Reserve Components Achievement Medal (ARCAM), the Reserve Component equivalent of the Army Good Conduct Medal.]
2. The applicant states:
* he served in the U.S. Army Reserve (USAR) and Army National Guard from August 1990 to August 1998
* he was awarded the Army Achievement Medal
* he should have been awarded three Army Good Conduct Medals
* he is currently serving on active duty in the U.S. Coast Guard
3. The applicant provides:
* National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service)
* Army National Guard discharge orders
* DA Form 2-1 (Personnel Qualification Record)
* Service personnel records
CONSIDERATION OF EVIDENCE:
1. Having completed 4 years of prior active service in the U.S. Navy, the applicant enlisted in the USAR on 31 August 1990 for a period of 8 years. He enlisted in the Army National Guard on 6 October 1993 for a period of 5 years. On 30 August 1998, he was honorably discharged from the Army National Guard and as a Reserve of the Army.
2. There are no orders for the Army Good Conduct Medal or ARCAM in the available records.
3. There is no evidence which shows he served on active duty during the period 31 August 1990 to 30 August 1998.
4. His DA Form 2-1 shows he was awarded the first award of the ARCAM for the period ending 30 August 1994. This award is shown on his NGB Form 22.
5. There is no evidence which shows he earned a minimum of 50 retirement points per year during the period 30 August 1994 to 30 August 1997.
6. Army Regulation 600-8-22 (Military Awards) states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified.
7. Army Regulation 600-8-22 states the ARCAM is authorized for award to Army personnel, including Active Guard Reserve officers, in the rank of colonel and below for exemplary behavior, efficiency, and fidelity while serving as a member of an Army National Guard or USAR troop program unit or as an individual mobilization augmentee. Such years of qualifying service must have been consecutive. A qualifying year of service is one in which a Reserve Soldier earns a minimum of 50 retirement points during his/her retirement year. Qualifying service for computation purposes is based only by retirement ending year dates.
a. Individuals must have completed 4 years of qualifying service on or after 3 March 1972 and before 28 March 1995.
b. Effective 28 March 1995, the period of qualifying service for award of the ARCAM is reduced from 4 to 3 years. This change is not retroactive.
DISCUSSION AND CONCLUSIONS:
1. The applicant requests three awards of the Army Good Conduct Medal for his service in the USAR and Army National Guard from August 1990 to August 1998.
2. The governing regulation states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service.
3. Since there is no evidence that shows he served a qualifying period of active duty enlisted service during the period August 1990 to August 1998, there is no basis for granting the requested relief.
4. The evidence shows he was awarded the first award of the ARCAM for the period ending 30 August 1994. Under current guidance, he would be eligible for the second award of the ARCAM for the period ending 30 August 1997. However, the evidence provided is insufficient to determine whether he earned a minimum of 50 retirement points per year during this period. Therefore, there is insufficient evidence on which to base a second award of the ARCAM in this case.
