THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected by adding his awards of the Iraq Campaign Medal (ICM) and the Meritorious Unit Commendation (MUC).

2.  The applicant states that his awards of the ICM and the MUC are missing from his DD Form 214.

3.  The applicant provides a copy of his DD Form 214, a copy of a letter of deployment, and copy of orders awarding his unit the MUC. 

CONSIDERATION OF EVIDENCE:

1.  The applicant was serving in the U.S. Army Reserve (USAR) when he was ordered to active duty in support of Operation Iraqi Freedom on 7 September 2008.  He deployed to Kuwait from 6 December 2008 to 21 June 2009 with the 180th Engineer Company.

2.  On 9 September 2009 Permanent Orders Number 252-07 issued by Human Resources Command in Alexandria, Virginia awarded the applicant’s unit the MUC for the period of 21 May 2008 to 1 July 2009.

3.  On 28 February 2010 the applicant was honorably released from active duty (REFRAD) due to completion of required service.  He had served 1 year, 5 months, and 24 days of active service.

4.  His DD Form 214 issued at the time of his REFRAD shows that he was awarded the Army Commendation Medal, the Army Good Conduct Medal, the National Defense Service Medal, the Global War on Terrorism Service Medal, the Army Service Ribbon, the Overseas Service Ribbon, and the Armed Forces Reserve Medal with “M” Device.

5.  Army Regulation 600-8-22 (Military Awards) states the Iraq Campaign Medal is awarded to members who have served in direct support of Operation Iraqi
Freedom (OIF).  The area of eligibility encompasses all the land area of the
country of Iraq, the contiguous water area out to 12 nautical miles, and all
air spaces above the land area of Iraq and above the contiguous water area
out to 12 nautical miles.  The Iraq Campaign Medal period of eligibility is
on or after 19 March 2003 to a future date to be determined by the Secretary
of Defense or the cessation of OIF.  A bronze service star is authorized for
wear with this medal for participation in each credited campaign.  Approved
campaigns are:

* Liberation of Iraq (19 March 2003-1 May 2003)
* Transition of Iraq (2 May 2003-28 June 2004)
* Iraqi Governance (29 June 2004-15 December 2005)
* National Resolution (16 December 2005-9 January 2007)
* Iraqi Surge (10 January 2007-31 December 2008)
* Iraqi Sovereignty (1 January 2009-31 August 2010)
* New Dawn (1 September 2010-to a date to be determined)

6.  Army Regulation 600-8-22 states a bronze service star based on qualifying service for each campaign listed in appendix B will be worn on the appropriate service medal.   

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s contention that his DD Form 214 does not contain his awards of the ICM and the MUC have been noted and found to have merit.

2.  The applicant served in two campaigns during a qualifying period for award of the ICM.  Accordingly, he is entitled to award of the ICM with two bronze service stars and to have it added to his DD Form 214. 

3. The applicant’s unit was also awarded the MUC during the period  he served in Iraq with the unit.  Accordingly, he is entitled to have that award added to his DD Form 214 as well.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the ICM with two bronze service stars and the MUC to his DD Form 214 for the period ending 28 February 2010.

2.  The Board wants the applicant and all others to know the sacrifices he made in service to the United States during the Global War on Terrorism are deeply appreciated.  The applicant and all Americans should be justifiably proud of his service in arms.
