		IN THE CASE OF:

		BOARD DATE:	  17 November 2011

		DOCKET NUMBER:  AR20110006467

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show she entered the Regular Army on
1 August 2000.

2. The applicant states her DD Form 214 incorrectly shows her date of entry into the Regular Army as 2 January 2010.

3. The applicant provides a copy of her DA Form 3286-59 (Statement for Enlistment).

CONSIDERATION OF EVIDENCE:

1.  The applicant's DD Form 4 (Enlistment/Reenlistment Document) shows:

	a.  she enlisted in the U.S. Army Reserve on 7 July 2000 for 8 years;

	b. she would enlist in the Regular component on 1 August 2000 for a period of 4 years; and

	c. she acknowledged she understood that her period of time in the delayed entry program (DEP) did not count for pay purposes or towards fulfillment of her military service obligation.

2. Records show the applicant enlisted in the Regular Army on 1 August 2000.

3. On 15 November 2004, the applicant reenlisted in the Regular Army for
3 years.

4. On 10 March 2006, the applicant either reenlisted or extended her term of service; however, the contract for this period of service is not available for review.

5. Special Orders Number 256-0255, Fort Bragg, North Carolina, dated
13 September 2010, directed the applicant's discharge effective 4 November 2010.

6. The applicant's DD Form 214 shows in Item 12 (Record of Service):

	a.  Item 12a (Date Entered Active Duty this Period): 2 January 2010;

	b. Item 12b (Separation Date this Period): 4 November 2010; and

	c. Item 12c (Net Active Service this Period): 10 years, 3 months, and 4 days.

7. Army Regulation 635-5 (Separation Documents) provides detailed instructions for completing separation documents, including the DD Form 214. The DD Form 214 is a summary of a Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. Items 12a, 12b, and 12c are to show the Soldier's dates of entry, separation, and net service for the period of the report.

DISCUSSION AND CONCLUSIONS:

The evidence of record clearly shows the applicant entered active duty on
1 August 2000 and was discharged on 4 November 2010. Her net active duty service for this period was 10 years, 3 months, and 4 days. However, Item 12a of her DD Form 214 incorrectly shows her date of entry as 2 January 2010. Accordingly, this error should be corrected.

BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

   a. deleting the entry in Item 12a of her DD Form 214; and

   b. adding in Item 12a of her DD Form 214 " 2000 08 01" indicating her date of enlistment was 1 August 2000.

    Her record contains a DD Form 4 that shows she enlisted in the RA on 16 October 1997 for a period of 3 years in the rank/grade of PV2/E-2. Therefore, her DD Form 214 for the period ending 15 May 2000 should be corrected to show she entered active duty this period on 16 October 1997. Based on this correction her net active service this period should also be corrected to show she completed 2 years and 7 months of service this period.

The applicant requests, in four applications, correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her correct dates of being absent without leave (AWOL) and to show her correct date of enlistment. Item 12a of the applicant’s DD Form 214, issued on 14 December 2006, shows she entered active duty on 25 October 2000. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. Therefore, item 12a should be corrected to show 21 August 2006 as the date she entered active duty.
