		BOARD DATE: 30 August 2011

		DOCKET NUMBER: AR20110004457

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his foreign service in Iraq.

2. The applicant states that item 18 (Remarks) of his DD Form 214 shows he completed 15 months of service in Iraq, yet item 12f (Foreign Service) does not reflect this service.

3. The applicant provides his DD Form 214.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the Regular Army on 13 July 2005. He completed training and was awarded military occupational specialty 63M (Bradley Fighting Vehicle System Maintainer).

2. His Enlisted Record Brief shows he was deployed to Iraq from 10 January 2007 through 27 March 2008, a period of 1 year, 2 months, and 18 days.

3. On 27 December 2008, he was honorably released from active duty and transferred to the South Carolina Army National Guard. His DD Form 214 shows he was credited with 3 years, 5 months, and 15 days of active service. The highest rank/grade he attained while serving on active duty was specialist/E-4.

* item 12f does not show completion of any foreign service
* item 18 contains the entry "SERVICE IN IRAQ 20070110-20080327"

4. The Defense Finance and Accounting Service (DFAS) records show the applicant received hostile fire/imminent danger pay and combat zone tax exclusion for Kuwait from 14 January 2007 through 28 March 2008.

5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active service or control of the Active Army. Chapter 2 contains guidance on the preparation of the DD Form 214. Paragraph 2-4 states that item 12f of the DD Form 214 documents the total amount of foreign service completed during the period of service represented in item 12c (Net Active Service This Period).

DISCUSSION AND CONCLUSIONS:

The preponderance of the evidence of record shows he deployed to Iraq from 10 January 2007 through 27 March 2008; therefore, he is entitled to correction of his DD Form 214 to show this foreign service.

BOARD DATE: 25 September 2012 DOCKET NUMBER: AR20120005431 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. The applicant contends that his DD Form 214 should show his correct foreign and combat service in Kuwait/Iraq. With respect to his deployed service, although the second period of service in Kuwait/Iraq from 17 March 2010 to 1 February 2011 is reflected in item 18 of his DD Form 214, the first period of service in Kuwait/Iraq from 27 December 2007 to 16 February 2009 is not.

He further states he was deployed to Iraq from August to December 2008 but item 12f of his DD Form 214 does not show his foreign service nor does his DD Form 214 show the actual dates he served in Iraq. Evidence of record shows the applicant entered active duty on 27 August 2007 and was discharged on 14 July 2009 which is 1 year, 10 months, and 18 days. However, evidence of record shows the applicant had 90 days lost time under Title 10 USC 972 from 15 April 2009 to 14 July 2009.

The applicant contends that he was deployed in Iraq from 11 October 2007 through 23 December 2008 and this period of foreign service should be show correctly shown on his DD Form 214. Therefore, it would be appropriate to correct the applicant’s DD Form 214 to show in: a. block 12f 1 year, 2 months, and 13 days; and b. block 18 "SERVICE IN KUWAIT/IRAQ FROM 11 OCTOBER 2007 – 23 DECEMBER 2008." _______ _ _x______ ___ CHAIRPERSON I certify that herein is recorded the true and complete record...

He states his DD Form 214 incorrectly shows his dates of deployment in Iraq as 2 June 2007 to 28 March 2008 and 3 March 2009 to 12 February 2010.
