THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his period of foreign service be correctly shown on his DD Form 214 (Certificate of Release or Discharge from Active Duty).

2.  The applicant states he was deployed in Iraq from 11 October 2007 through 23 December 2008. 

3.  The applicant provides copies of a Soldier Deployment History Outprocessing Report and his DD From 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant served on active duty in the Regular Army from 27 October 2004 through 2 April 2009 as an Intelligence Analyst. 

2.  The Soldier Deployment History Outprocessing Report shows the applicant was deployed from 11 October 2007 through 23 December 2008.

3.  A review of the applicant's pay information shows he served in a combat zone (Kuwait) and received hostile fire pay from 1 October 2007 through 31 December 2008.

4.  The applicant’s DD Form 214, block 12f (Foreign Service) shows 2 months and 17 days.  Item 18 (Remarks) does not note his deployment.

5.  Army Regulation 635-5 (Separation Documents) provides the following pertinent instructions for completing the DD Form 214:

   a.  in Block 12f enter the total amount of foreign service completed during the period covered by the 214; and

	b.  Block 18 the following statement is mandatory for denoting foreign service in an area for which hostile fire pay or imminent danger pay was authorized:  "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example:  YYYYMMDD - YYYYMMDD)." 

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that he was deployed in Iraq from 11 October 2007 through 23 December 2008 and this period of foreign service should be show correctly shown on his DD Form 214.

2.  Based on the available information the applicant did serve in both Kuwait and/or Iraq from 11 October 2007 through 23 December 2008 and this period of service equals 1 year, 2 months, and 13 days.  Therefore, it would be appropriate to correct the applicant’s DD Form 214 to show in:

	a.  block 12f 1 year, 2 months, and 13 days; and 

	b.  block 18 "SERVICE IN KUWAIT/IRAQ FROM 11 OCTOBER 2007 –
23 DECEMBER 2008."

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

a. deleting the current entry that is shown in block 12f and adding 1 year, 
2 months, and 13 days; and 

	b.  in block 18 "SERVICE IN KUWAIT/IRAQ FROM 11 OCTOBER 2007 – 
23 DECEMBER 2008."
