THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Combat Infantryman Badge and any other awards and decorations he may be entitled to receive.

2.  The applicant states, in effect, his personnel record shows he is entitled to the requested award. 

3.  The applicant did not provide any evidence.

CONSIDERATION OF EVIDENCE:

1.  The applicant's records show he enlisted in the Regular Army on 13 June 2007 and he served in military occupational specialty (MOS) 11B (Infantryman).  He was assigned to C Company, 1st Battalion, 32nd Infantry, Fort Drum, NY.  He served in Afghanistan in support of Operation Enduring Freedom from 
12 January 2009 to 9 January 2010.  

2.  On 2 October 2010, he was honorably released from active duty and transferred to the U.S. Army Reserve Control Group to complete his remaining service obligation.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows the:

* Afghanistan Campaign Medal with Campaign Star
* Army Commendation Medal with "V" Device
* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Army Service Ribbon
* Overseas Service Ribbon
* North Atlantic Treaty Organization Medal

3.  Permanent Orders 321-203, issued by Task Force Mountain Warrior, Afghanistan, on 17 November 2009, awarded him the Army Commendation Medal for meritorious service from 15 January 2009 to 14 January 2010.

4.  On 28 June 2011, by email, the Brigade S-1, 3rd Brigade Combat Team (Forward), Afghanistan, notified the case analyst of record that based on the applicant's Army Commendation Medal with "V" Device, permanent orders were published to award him the Combat Infantryman Badge.  A copy of this order would be posted to his official records. 

5.  Army Regulation 600-8-22 (Military Awards) states there are basically three requirements for award of the Combat Infantryman Badge.  The Soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat. 

DISCUSSION AND CONCLUSIONS:

1.  The applicant held an infantry MOS and he was assigned to an infantry company during his service in Afghanistan.  His Army Commendation Medal with "V" Device clearly shows he actively participated in ground combat with his unit.  His chain of command published the orders.  Therefore, he is entitled to correction of his DD Form 214 to show the Combat Infantryman Badge.

2.  Permanent orders awarded him two awards of the Army Commendation Medal, one of which is not shown on his DD Form 214; therefore, he is entitled to correction of his DD Form 214 to show both awards.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* deleting from item 13 of his DD Form 214 the Army Commendation Medal with "V" Device
* adding to item 13 of his DD Form 214 the Combat Infantryman Badge and the Army Commendation Medal (2nd Award) and with "V" Device
