THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his Official Military Personnel File (OMPF) in the interactive Personnel Electronic Management System (iPERMS) by removing an illegible duplicate copy of an award certificate for the Meritorious Service Medal.

2.  The applicant states a legible copy of the award certificate was placed in his OMPF, but the illegible copy was not removed.

3.  The applicant provides no additional documentation.

CONSIDERATION OF EVIDENCE:

1.  At the time of his application, the applicant was serving on active duty in the Regular Army in the rank/grade of master sergeant (MSG)/E-8.

2.  The performance section of the applicant's OMPF contains two award certificates, dated 5 March 2010.  They both award the applicant the Meritorious Service Medal for the period 9 July 2009 to 30 June 2010.  They are identical except for legibility.

3.  Army Regulation 600-8-104 (Military Personnel Information Management/
Records) provides that once a document is placed in the OMPF it becomes a permanent part of that file.  The document will not be removed from the OMPF, or moved to another part of the OMPF, unless directed by:

* The Army Board for Correction of Military Records (ABCMR)
* The Department of the Army Suitability Evaluation Board (DASEB)
* Army appeal boards
* Chief, Appeals and Corrections Branch, U.S. Army Human Resources Command
* The OMPF custodian when documents have been improperly filed
* Chief, Appeals Branch, Army Reserve Personnel Center
* Chief, Appeals Branch, National Guard Personnel Center

DISCUSSION AND CONCLUSIONS:

1.  The applicant's OMPF clearly contains two copies of the same award certificate.  One of these certificates is of poor quality and it should be removed from the file to preclude confusion.

2.  In view of the above, the applicant's request should be granted.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from the performance section of the applicant's OMPF the illegible copy of the award certificate awarding him the Meritorious Service Medal for the period 9 July 2009 to 30 June 2010, dated 5 March 2010.
