THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests award of the Presidential Unit Citation (PUC) and its addition to his DD Form 214 (Certificate of Release or Discharge from Active Duty).

2.  He states that he served with the 3rd Armored Cavalry Regiment during Operation Iraqi Freedom (OIF) in 2005 and he recently learned the PUC was awarded to his unit in 2008.  He was medically discharged in 2009.  He also states he is providing his recommendation for the Army Commendation Medal to show he was in Iraq during the entire period of deployment.

3.  He provides:

* 2005 assignment orders
* 2005 OIF deployment orders
* DA Form 638 (Recommendation For Award)
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  The applicant's military records show he enlisted in Regular Army on 12 August 2003.  



2.  Permanent Order 048-03 was issued by the 7th Infantry Division on 17 February 2005 assigning him to the 1st Squadron, 3rd Armored Cavalry Regiment in support of OIF 04-06, effective 1 March 2005, for a period of 
365 days.

3.  He provided a DA Form 638 recommending him for award of the Army Commendation Medal for meritorious service during OIF from 4 March 2005 to 7 March 2006.  This award was approved on 12 December 2005. 

4.  He was honorably discharged in pay grade E-4 on 6 October 2009, for a non-combat related disability.  

5.  Item 13 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 list the following awards:

* Army Commendation Medal
* Army Achievement Medal (4th Award)
* Army Good Conduct Medal (2nd Award)
* National Defense Service Medal
* Global War on Terrorism Expeditionary Medal
* Korean Defense Service Medal
* Global War on Terrorism Service Medal
* Army Service Ribbon
* Overseas Service Ribbon
* Marksman Marksmanship Qualification Badge with Rifle Bar
* Basic Air Force Space Badge

6.  Item 18 (Remarks) of his DD Form 214 shows he served in Iraq from 5 March 2005 through 17 February 2006.  

7.  A review of the Army Human Resources Command, Military Awards Branch index of general orders failed to reveal orders awarding the 3rd Armored Cavalry Regiment the PUC during OIF.

8.  Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the PUC is awarded for extraordinary heroism in action.  A unit must display such gallantry, determination, and esprit de corps in accomplishing its mission as would warrant award of the Distinguished Service Cross to an individual.  





DISCUSSION AND CONCLUSIONS:

1.  The evidence of record does not show the applicant's unit, the 3rd Armored Cavalry Regiment, was awarded the PUC during his period of service in Iraq.  Therefore, he has not established that he is entitled to award of the PUC.

2.  In view of the foregoing, there is no basis for granting the applicant's request.
