IN THE CASE OF:
BOARD DATE: 14 MAY 2009
DOCKET NUMBER: AR20080019314
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, award of the Presidential Unit Citation (PUC) and all unit citations/awards authorized.
2. The applicant states that these awards should be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty).
3. The applicant provides a copy of his DD Form 214.
CONSIDERATION OF EVIDENCE:
1. The applicant's military records show he enlisted in the Army National Guard (ARNG) on 8 July 1999. On 15 November 2003, he was ordered to active duty in support of Operation Iraqi Freedom. The applicant was deployed in Iraq from 23 February 2004 to 22 February 2005 and was assigned to Troop E, 303rd Cavalry Regiment. He was honorably released from active duty on 5 April 2005.
2. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 shows the following: Army Commendation Medal, Army Achievement Medal (2nd Award), National Defense Service Medal, Global War on Terrorism Expeditionary Medal, Global War on Terrorism Service Medal, Armed Forces Reserve Medal with "M" Device, Army Service Ribbon, Army Good Conduct Medal, Overseas Service Bar (2nd Award), Overseas Service Ribbon, and Driver and Mechanic Badge with Driver-W Bar. This form does not show award of the PUC or any unit citations/awards.
3. A search of the internet revealed that Troop E, 303rd Cavalry Regiment, was an element under the 81st Armored Brigade Combat Team, ARNG, Washington.
There is no indication that the 303rd Cavalry Regiment earned any type of awards while deployed in support of Operation Iraqi Freedom. The organizational notes listed in the history of the 81st Armored Brigade Combat Team shows that Troop E, 303rd Cavalry Regiment, no longer exists.
4. The U.S. Army Human Resources Command awards and decorations website lists all approved unit awards. The website does not show that Troop E, 303rd Cavalry Regiment, or the 81st Armored Brigade Combat Team was awarded the PUC or any unit citations/awards.
5. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Presidential Unit Citation is awarded for extraordinary heroism in action. A unit must display such gallantry, determination, and esprit de corps in accomplishing its mission as would warrant award of the Distinguished Service Cross to an individual.
DISCUSSION AND CONCLUSIONS:
There is no evidence and the applicant has not provided any to show that his unit was awarded the PUC or any type of unit awards. As such, there is no evidence to show that the applicant is entitled to the award of the PUC or any unit awards during his service with Troop E, 303rd Cavalry Regiment.
BOARD VOTE:
