THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests removal of a Combat Lifesaver Course Certificate from his official military personnel file (OMPF).
2. The applicant states he did not take the Combat Lifesaver Course and he wants the certificate removed from his OMPF.
3. The applicant provides a copy of the certificate in question.
CONSIDERATION OF EVIDENCE:
1. The applicant's military record shows he was appointed as a first lieutenant in the Alabama Army National Guard in the Judge Advocate General's Corps on 21 August 2003. He executed his oath of office at that time.
2. The performance portion of the applicant's OMPF includes a certificate which shows he attended Class Number 04-504 and successfully completed the Combat Lifesaver Course in Birmingham, Alabama. His DA Form 2-1 (Personnel Qualification Record) includes an entry in item 17 (Civilian Education and Military Schools) showing he completed 1 week of training in 2004 in the course in question.
3. Army Regulation 600-8-104 (Military Personnel Information Management/
Records) provides that all personnel information recorded under the authority of this regulation is the property of the U.S. Government. Once recorded, it will not be removed except as provided by law or this regulation. Once placed in the OMPF, the document becomes a permanent part of that file. Table 6-4 states that a member's military education will be recorded in item 17 of the DA Form 2-1 and table 6-5 indicates the certificate of highest military education will be filed in the performance section of the OMPF.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends the Combat Lifesaver Course certificate should be removed from his OMPF because he did not attend or complete this course.
2. By regulation, a member's military education will be recorded in item 17 of the DA Form 2-1 and the certificate of highest military education will be filed in the performance section of the OMPF. Once a document is placed in the OMPF, the document becomes a permanent part of that file.
3. The evidence of record shows the applicant successfully completed 1 week (40 hours) of training in the Combat Lifesaver Course. The applicant has not provided any documentary evidence to corroborate his claim that he did not complete this training.
4. Should the applicant have or be able to obtain official documentation showing he did not complete this training, he may submit another application for consideration.
5. In view of the foregoing, the applicant's request should be denied.
