IN THE CASE OF:
BOARD DATE: 14 September 2010
DOCKET NUMBER: AR20100018535
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that a duplicate promotion order be removed from his official military personnel file (OMPF).
2. The applicant states that while he was on temporary duty (TDY) in August 2006, his TDY unit and home unit both issued him promotion orders to sergeant (SGT)/E-5.
3. The applicant provides Headquarters, U.S. Army Medical Center and School, Fort Sam Houston, Texas, Orders 236-801, dated 24 August 2006, and Headquarters, U.S. Army Aviation Center, Fort Rucker, Alabama,
Orders 242-00226, dated 30 August 2006, in support of this application.
CONSIDERATION OF EVIDENCE:
1. The applicant is currently serving on active duty in the rank of staff sergeant/
E-6.
2. His OMPF contains Orders 236-801, dated 24 August 2006, issued by Headquarters, U.S. Army Medical Center and School, promoting him to SGT/E-5 effective 1 September 2006.
3. His OMPF also contains Orders 242-00226, dated 30 August 2006, issued by Headquarters, U.S. Army Aviation Center, promoting him to SGT/E-5 effective 1 September 2006.
4. Army Regulation 600-8-104 (Military Personnel Information Management/
Records) provides that once a document is placed in the OMPF, it becomes a permanent part of that file. The document will not be removed from or moved to another part of the OMPF unless directed by the Army Board for Correction of Military Records.
DISCUSSION AND CONCLUSIONS:
1. The applicant's contention that his OMPF erroneously contains two SGT/E-5 promotion orders and that one should be removed from his OMPF was carefully reviewed.
2. Orders 242-00226, dated 30 August 2006, duplicated a previously-issued promotion order; therefore, it is clearly in error. His promotion to SGT/E-5 was previously announced by Orders 236-801, dated 24 August 2006. As a result, it would be appropriate to revoke Orders 242-00226, dated 30 August 2006.
3. Orders 242-00226, dated 30 August 2006, were issued as the result of an administrative error. These orders hold no historical value in documenting the applicant's military career. Therefore, it would be appropriate to remove these orders from his OMPF. Furthermore, the revocation order should not be filed in his OMPF.

The applicant states, in effect, that a duplicate order awarding him the Good Conduct Medal (Fourth Award) and the corresponding order revoking that order are filed in the performance section of his OMPF and this may give members of a future Command Sergeants Major promotion selection board a false impression that the award was actually taken away from the applicant. The evidence of record confirms that the applicant was properly awarded the Good Conduct Medal (Fourth Award) by permanent...

The applicant requests that Orders Number C-103-179, which promoted him to the rank of sergeant (SGT)/pay grade E-5 effective 18 April 1991 (sic), be removed from his Official Military Personnel Files (OMPF).
