		IN THE CASE OF:

		BOARD DATE: 21 December 2010

		DOCKET NUMBER: AR20100016443

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests block 12b (Separation Date This Period) of her
DD Form 214 (Certificate of Release or Discharge from Active Duty) be changed from "2007 07 20" to "2007 12 10."

2. The applicant states "2007 12 10" was the last day she pulled drill; therefore, her DD Form 214 is incorrect.

3. The applicant provides:

* her DD Form 214
* Orders 007-810, Joint Force Headquarters, Tennessee National Guard, Nashville, TN, dated 7 January 2008

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the Tennessee Army National Guard (TNARNG) on 10 March 2007.

2. The applicant reported to Fort Gordon, GA in an active duty for training (ADT) status on 3 April 2007. She was released from ADT on 20 July 2007 upon completion of training, issued a DD Form 214, and returned to her TNARNG unit. Item 12b (Separation Date This Period) of her DD Form 214 shows the entry "2007 07 20."

3. The applicant was subsequently discharged from the TNARNG and as a Reserve of the Army on 11 December 2007. She was issued a National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) that shows she served 9 months and 2 days of net service this period.

4. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214. The
DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty (emphasis added). It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge and states a
DD Form 214 will be prepared for each Reserve Component (RC) Soldier completing 90 days or more of continuous ADT. It further states, for item 12b, enter the Soldier's transition date.

DISCUSSION AND CONCLUSIONS:

1. The applicant was a TNARNG Soldier. She was ordered to active duty for her initial entry training. Upon completion of her training she was issued a DD Form 214 when she was released from active duty on 20 July 2007. She was subsequently discharged from the TNARNG and as a Reserve of the Army on 11 December 2007.

2. The applicant's DD Form 214 is correct as completed. Her release from ADT and her discharge from the TNARNG and as a Reserve of the Army are two completely different events on two separate dates.

3. In view of the foregoing, there is no basis for granting the applicant's request.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

__X_____ ___X____ ____X___ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.
