THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


CONSIDERATION OF ADDITIONAL EVIDENCE:

12.  On 22 February 2010, new information was received from LTC L------ S.
C---------, Personnel Policy Integrator, Deputy Chief of Staff, G-1 in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20080001962, dated 17 June 2008.

13.  The evidence submitted consists of an email from LTC C---------, dated 22 February 2010.

ADDITIONAL DISCUSSION AND CONCLUSIONS:

4.  At the time of the decision of the ABCMR in Docket Number AR20080001962, dated 17 June 2008, it was the intent of the ABCMR to make the applicant’s record as administratively correct as it should properly have been at the time.

5.  The ABCMR's decision in Docket Number AR20080001962 failed to indicate the corrections that would be made to the applicant’s records if she is selected for promotion to colonel (COL) by a duly constituted Special Selection Board (SSB) under the 1998, 1999, and 2000 criteria.

6.  The BOARD RECOMMENDATION should have included guidance that if the applicant was selected for promotion her records should be further corrected by promoting her to COL and assigning the appropriate date of rank with appropriate back pay and allowances and also that if she is not selected for promotion, she be notified accordingly.

BOARD DETERMINATION/RECOMMENDATION:

3.  The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the ABCMR set forth in Docket Number AR20080001962, dated 17 June 2008, to add in paragraph 1 of the BOARD RECOMMENDATION:

	a.  That if she is selected for promotion her records be further corrected by promoting her to COL, assigning the appropriate date of rank, and paid any associated back pay and allowances; and 

	b.  That if she is not selected for promotion, she be notified accordingly.
