THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests removal of a DA Form 1059 (Service School Academic Evaluation Report), signed on 20 October 2009 and filed in her Official Military Personnel File (OMPF) on 25 November 2009.

2.  The applicant states she submitted the first copy of the DA Form 1059 after her graduation from the course.  She states the school later contacted her indicating minor corrections had to be made to the form and she was required to sign a second form (digital signature used).  The corrected copy was then submitted to her OMPF.

3.  The applicant provides no additional evidence in support of her application.

CONSIDERATION OF EVIDENCE:

1.  The applicant is a staff sergeant currently serving on active duty.

2.  A DA Form 1059, signed on 20 October 2009, shows the applicant attended the SLC (Senior Leader Course) (42A) 020-09 from 14 September 2009 through 20 October 2009.  This form contains hand-written signatures and was filed in her OMPF on 25 November 2009.


3.  A DA Form 1059, digitally signed on 23 November 2009, shows the applicant attended the SLC (42A) 904-09 from 14 September 2009 through 20 October 2009.  This form was filed in her OMPF on 29 December 2009

4.  Army Regulation 600-8-104 (Military Personnel Information Management/ Records), provides in Table 2-1 (Composition of the OMPF) that DA Forms 1059 are filed in the Performance Section of the OMPF.  This regulation also provides that once filed, such documents become a permanent part of the OMPF and may only be removed by one of several agencies, one of which is the Army Board for Correction of Military Records (ABCMR).

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends the DA Form 1059 signed on 20 October 2009 should be removed from her OMPF.

2.  The only difference between the two DA Forms 1059 is the course number.  Apparently due to an administrative error the incorrect course number was entered on the DA Form 1059, signed on 20 October 2009.  Therefore, a corrected DA Form 1059, digitally signed on 23 November 2009, was filed in the applicant's OMPF on 29 December 2009.

3. The DA Form 1059, signed on 20 October 2009, contains an administrative error by the school.  This form holds no historical value in documenting the applicant's military career.  Therefore, it would be appropriate to remove this form from the applicant's OMPF.
