		IN THE CASE OF:

		BOARD DATE:	  15 July 2010

		DOCKET NUMBER:  AR20090021428

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests reconsideration of his previous request to correct item 11 (Primary Specialty) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show military occupational specialty (MOS) 88M2O (Motor Transport Operator) and MOS 11B2O (Infantryman).

2. The applicant states this correction was not approved because he failed to provide the necessary supporting documentation.

3.  The applicant provides:

* Army Board for Correction of Military Records (ABCMR) Record of Proceedings Docket Number AR20090003328, dated 7 July 2009
* DA Form 2-1 (Personnel Qualification Record - II)
* DD Form 214 for the period 20030207-20040420
* DD Form 2586 (Verification of Military Experience and Training)
* U.S. Marine Corps Certificate of Training - Motor Vehicle Operator
* page 4 of 10, Unit Manning Report

CONSIDERATION OF EVIDENCE:

1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20090003328 on 7 July 2009.

2. The documents provided by the applicant constitute new evidence requiring reconsideration by the Board.

3. The applicant's DA Form 2-1, item 6 (Military Occupational Specialties), shows he held MOS 88M2O (Motor Transport Operator) as a secondary MOS from 1 December 2000. It also shows he held MOS 11B2O (Infantryman) as an additional MOS from 1 December 2000.

4. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his/her military service. It is important that information entered on the form be complete and accurate. This regulation specifies that the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. The DD Form 214 is prepared for all personnel at the time of their retirement, discharge, or release from active duty. Item 11 of the DD Form 214 reflects military occupational specialties. This item contains titles of all MOS's held or served for at least 1 year and includes for each MOS the number of years and months served. The regulation provides information found in item 11 will be derived from the Enlisted Record Brief.

DISCUSSION AND CONCLUSIONS:

The applicant held MOS 88M2O and MOS 11B2O from 1 December 2000. When he served on active duty, he still held those two specialties. They should both be added to item 11 of his DD Form 214 and the "years and months held" should be entered as 3 years and 5 months (from 1 December 2000 to 20 April 2004).

BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented was sufficient to warrant amendment of the ABCMR's decision in Docket Number AR20090003328, dated 7 July 2009. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by entering the following information, or abbreviations thereof, in item 11 of his DD Form 214:

* 88M2O MOTOR TRANSPORT OPERATOR – 3 YRS – 5 MOS
* 11B2O INFANTRYMAN – 3 YRS – 5 MOS

    The applicant requests item 11 (Primary Specialty) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected. His AARTS transcript shows he held primary MOS 88M2O from February 2005 to present [6 November 2006, his separation date] for a total of 1 year and 8 months. Therefore, item 11 of his DD Form 214 should be corrected to show he served in MOS 42A2O for 3 years and 2 months and in MOS 88M2O for 1 year and 8 months.

    The applicant requests reconsideration of the Army Board for Correction of Military Records (ABCMR) decision denying him award of the Combat Infantryman Badge because he didn't have an infantry military occupational specialty (MOS). The applicant contends his MOS is incorrectly reflected in his military personnel records and he should have been awarded the Combat Infantryman Badge. His DD Form 20 does not show him being awarded the MOS of 11B.

    The applicant's record shows he enlisted in the Regular Army and entered active duty on 22 February 2000. Although there are regulatory provisions for separating a Soldier who entered into an erroneous enlistment contract or unfulfilled enlistment commitment, in view of the facts of this case and based on the recommendation of the Chief, Personnel Division, ARNG, it would be appropriate and serve the interest of justice and equity to correct his record by showing he held MOS 88M at the time...

    The applicant's military service records are not available to the Board for review. Therefore, in the absence of orders awarding the applicant MOS 11B as his PMOS or some other substantiating evidence, there is insufficient evidence to support correction of the applicant’s separation orders and final DD Form 214, particularly in view of the evidence below. While the evidence of record indicates that the applicant was assigned to an infantry unit and he may have performed the duties of an...
