THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his previous request to correct his records to show entitlement to a Valorous Unit Award.

2.  The applicant states his unit (137th Engineer Company, 19th Engineer Battalion) was awarded a Valorous Unit Award in 2009 for the period 23 May 1968 through 14 May 1969.

3.  The applicant provides a copy of U.S. Army Human Resources Command Permanent Orders 252-09, dated 9 September 2009, confirming the award.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20060011312 on 8 March 2007.

2.  On 9 September 2009 elements of the 19th Engineer Battalion and the 137th Engineer Company were awarded the Valorous Unit Award for extraordinary heroism in action against an armed enemy during the period 16 July 1967 to 
31 December 1968.  The applicant was a member of the 137th Engineer Company while deployed to Vietnam between May 1968 and May 1969.


3.  Appendix B of Army Regulation 600-8-22 (Military Awards) shows the campaigns for Vietnam.  During the applicant’s tours in Vietnam he participated in four campaigns.  This same regulation states that a bronze service star will be awarded for wear on the Vietnam Service Medal for participation in each campaign.  

4.  Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) also shows the applicant is eligible to wear the Republic of Vietnam Gallantry Cross with Palm Unit Citation based on Department of the Army General Orders Number 8, dated 1974.

DISCUSSION AND CONCLUSIONS:

1.  The evidence now confirms the applicant is entitled to the Valorous Unit Award which was awarded to the 137th Engineer Company for the period 12 July 1967 to 31 December 1968.  The applicant was a member of the company between May 1968 and May 1969.  His records should be corrected accordingly.

2.  A further review of the applicant’s file also shows he is entitled to four bronze service stars on his Vietnam Service Medal and the Republic of Vietnam Gallantry Cross First Class Unit Citation.  His records should be corrected accordingly.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20060011312, dated 8 March 2007.  As a result, the Board recommends that all Department of the 
Army records of the individual concerned be corrected by adding to his 1969 
DD Form 214 the Valorous Unit Award, four bronze service stars to be worn on 



his already-awarded Vietnam Service Medal, and the Republic of Vietnam Gallantry Cross with Palm Unit Citation.
