THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show a second award of the Army Commendation Medal.

2.  The applicant states she did not receive her expiration of term of service (ETS) award of the Army Commendation Medal until after she was released from active duty.

3.  The applicant provides:

* DA Form 638 (Recommendation for Award)
* orders for the Army Commendation Medal
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  Having prior enlisted service in the Regular Army, the applicant was commissioned as a second lieutenant on 7 September 2006 and entered active duty that date.  She served as an engineer officer and was honorably discharged in the rank of first lieutenant on 7 September 2009 for miscellaneous/general reasons.

2.  Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 for the period ending      7 September 2007 shows, among other awards, the Army Commendation Medal as an authorized award.

3.  Headquarters, Division Support Command, 25th Infantry Division (Light), Permanent Order Number 269-09, dated 26 September 2001, shows the applicant received the Army Commendation Medal for the period 1 November 1989 to 14 September 2001.

4.  Headquarters, 130th Engineer Brigade, Permanent Order Number 223-03, dated 11 August 2009, shows the applicant received the Army Commendation Medal for the period 20 July 2007 to 30 July 2009 (ETS award).

5.  Army Regulation 600-8-22 (Military Awards) states an oak leaf cluster is awarded to denote the second and succeeding awards of certain decorations, among which is the Army Commendation Medal.

DISCUSSION AND CONCLUSIONS:

The applicant's DD Form 214 shows one award of the Army Commendation Medal.  However, orders show she received two awards of the Army Commendation Medal.  Therefore, her DD Form 214 should be corrected to show the Army Commendation Medal with First Oak Leaf Cluster.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by 


deleting from item 13 of her DD Form 214 for the period ending 7 September 2007 the entry, "Army Commendation Medal" and replacing it with the entry "Army Commendation Medal (First Oak Leaf Cluster)."
