THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of the Army Board for Correction of Military Records (ABCMR) Docket Number AR20070018019 that denied the addition of the Bronze Star Medal with "V" device and a second Bronze Star Medal for meritorious achievement to his DD Form 214 (Report of Separation from Active Duty) with an effective date of 6 September 1970.

2.  The applicant states, in effect, he located the orders awarding him the Bronze Star Medal with "V" device.

3.  The applicant provides, in support of his application, two certificates for the award of the Bronze Star Medal, one with the "V" device; an unsigned citation for the award of the Bronze Star Medal; and orders awarding him the Bronze Star Medal with "V" device.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20070018019 on 29 April 2008.

2.  In the original findings, the ABCMR determined there was insufficient evidence to show the applicant was awarded the Bronze Star Medal with "V" device.  The ABCMR also determined there was insufficient evidence to show the applicant was awarded a second Bronze Star Medal for meritorious achievement.
3.  Headquarters, 18th Engineer Brigade General Orders Number 208, dated 
27 February 1971, submitted by the applicant, is new evidence which require that his case be reconsidered by the ABCMR.

4.  Headquarters, 1st Infantry Division General Orders Number 4453, dated 
19 March 1970, contained in the applicant's Military Personnel Record Jacket (MPRJ), awarded the applicant the Bronze Star Medal for meritorious achievement during the period from 27 October 1969 to 11 March 1970.

5.  Headquarters, 18th Engineer Brigade General Orders Number 208, dated 
27 February 1971, awarded the applicant the Bronze Star Medal with "V" device for heroism in connection with military operations against a hostile force in the Republic of Vietnam during the period from 10 July 1970 to 1 September 1970.

6.  Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of the applicant’s DD Form 214
shows he was awarded the Bronze Star Medal.  Item 24 does not show he was awarded the Bronze Star Medal with "V" device.

7.  Army Regulation 600-8-22 (Military Awards) states, in pertinent part, that an oak leaf cluster is awarded to denote the second and succeeding awards of certain decorations, among which is the Bronze Star Medal.

8.  Army Regulation 600-8-22 also provides, in pertinent part, that the “V” device is worn to denote participation in acts of heroism involving conflict with an armed enemy.

DISCUSSION AND CONCLUSIONS:

The orders submitted by the applicant clearly show he was awarded the Bronze Star Medal with "V" device on 27 February 1971 in addition to the Bronze Star Medal he had previously been awarded on 19 March 1970.  Therefore, it is appropriate to amend the applicant's DD Form 214 to show he was awarded the Bronze Star Medal with First Oak Leaf Cluster and "V" device.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20070018019, dated 29 April 2008.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 24 of the applicant's DD Form 214 to show he was awarded the Bronze Star Medal with first oak leaf cluster and with "V" device.
