THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests removal of an Army Commendation Medal from his Official Military Personnel File (OMPF).

2.  The applicant states, in effect, that he was recommended for award of the Bronze Star Medal that was initially downgraded to an Army Commendation Medal.  The recommendation was resubmitted and approved without the downgrade.  As a result, both awards have been filed on his OMPF. 

3.  The applicant provides, in support of his application, copies of certificates and award recommendations for both the Army Commendation Medal and the Bronze Star Medal. 

CONSIDERATION OF EVIDENCE:

1.  At the time of his application, the applicant was serving on active duty as a master sergeant, pay grade E-8.

2.  Review of the applicantÂ’s OMPF shows that he was awarded the Army Commendation Medal on 28 October 2006 for meritorious service during Operation Iraqi Freedom, from 14 January 2006 to 14 January 2007.  It also shows that he was awarded the Bronze Star Medal on 2 January 2007 for meritorious service during Operation Iraqi Freedom, from 14 January 2006 to 
14 January 2007.

3.  Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that only one decoration will be awarded to an individual for the same act, achievement, or period of meritorious service.

4.  Army Regulation 600-8-104 (Military Personnel Information Management/ Records) provides, in pertinent part, that once a document is placed in the OMPF, it becomes a permanent part of that file.  The document will not be removed from the fiche or moved to another part of the fiche unless directed by the Army Board for Correction of Military Records. 

DISCUSSION AND CONCLUSIONS:

1.  The applicant's records show that he was awarded the Army Commendation Medal and the Bronze Star Medal for the same period of meritorious service.

2.  The applicant has provided convincing evidence showing that the Army Commendation Medal was an erroneous award once the Bronze Star Medal for the same period of service had been issued.

3.  The Army has an interest in maintaining the accuracy of its records.  Therefore, it is prudent to revoke the Army Commendation Medal orders issued on 28 October 2006 and to remove all documents from the applicant's OMPF pertaining to award of the Army Commendation Medal issued on 28 October 2006.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by revoking the Army Commendation Medal orders issued on 28 October 2006 and then removing from his OMPF all documents pertaining to award of the Army Commendation Medal issued on 28 October 2006 (and ensuring the revocation orders are not filed).
