The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion, if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests removal of the award order and certificate for an Army Commendation Medal dated 6 December 2006 from his Official Military Personnel File (OMPF).

2. The applicant states that he was awarded the Army Commendation Medal as an interim award. It was subsequently replaced by a Bronze Star Medal which is filed in his OMPF.

3. The applicant provides no supporting documentation.

CONSIDERATION OF EVIDENCE:

1. At the time of his application, the applicant was serving on active duty as a staff sergeant, pay grade E-6, in Afghanistan.

2. Permanent Orders Number 340-015, Combined/Joint Task Force-180, Bagram Air Field, Afghanistan, dated 6 December 2006, awarded the applicant the Army Commendation Medal for exceptionally meritorious service in support of Operation Enduring Freedom, during the period from 31 January 2006 to
30 January 2007.

3. Permanent Orders Number 26-276, Combined/Joint Task Force-180, Bagram Air Field, Afghanistan, dated 26 January 2007, awarded the applicant the Bronze Star Medal for exceptionally meritorious service in support of Operation Enduring Freedom, during the period from 31 January 2006 to 30 January 2007.

4. Permanent Orders Number 26-277, Combined/Joint Task Force-180, Bagram Air Field, Afghanistan, dated 26 January 2007, revoked Permanent Orders Number 340-015.

5. Review of the applicant’s records shows that all of the above mentioned award orders were filed in his OMPF.

6. Army Regulation 600-8-104 (Military Personnel Information Management/Records) provides, in pertinent part, that once a document is placed in the official military personnel file, it becomes a permanent part of that file. The document will not be removed from the fiche or moved to another part of the fiche unless directed by The Army Board for Correction of Military Records.

7. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that only one decoration will be awarded to an individual or unit for the same act, achievement, or period of meritorious service.

DISCUSSION AND CONCLUSIONS:

1. The available evidence clearly shows that the applicant was awarded the Army Commendation Medal and Bronze Star Medal for the same meritorious service and that the Army Commendation Medal was subsequently revoked.

2. The Army has an interest in maintaining the accuracy of its records. It is also important that these records be as concise as possible to help preclude misinterpretation by individuals or boards during their review of these records. Therefore, it is prudent to remove unauthorized award orders.

3. Therefore, Permanent Orders Number 340-015, dated 6 December 2006 should be removed from the applicant's OMPF.

BOARD VOTE:

__JAM __ __KAN __ __SAP__ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing Permanent Orders Number 340-015, dated 6 December 2006 from his OMPF.

The applicant's military service records contain a copy of her DD Form 214 that shows she was honorably released from active duty based upon completion of required active service on 23 July 2005. The applicant's military service records contain a copy of an ERB, dated 29 June 2005. Therefore, it would be appropriate to correct the applicant's DD Form 214 to show this award.
