		IN THE CASE OF:

		BOARD DATE: 14 JULY 2009

		DOCKET NUMBER: AR20090004950

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests the removal of three duplicate award certificates from his Official Military Personnel File (OMPF). The certificates are identified by Permanent Order (PO) Numbers (#s) 243-22, 227-01 and 152-12.

2. The applicant states the certificates are duplicates and should not be in his OMPF.

3. The applicant provides copies of the three certificates.

CONSIDERATION OF EVIDENCE:

1. The applicant is a Regular Army Sergeant First Class (SFC/E-7). In 2007, he was serving as a Drill Sergeant with the 169th Engineer Battalion, 1st Engineer Brigade, Fort Leonard Wood, MO.

2. The applicant was selected as Battalion Drill Sergeant for the 2nd Quarter, Calendar Year (CY) 2007. For this achievement, he was awarded the Army Achievement Medal by PO # 227-01.

3. The applicant was selected as Brigade Drill Sergeant for the 2nd Quarter, CY 2007. For this achievement, he was awarded the Army Achievement Medal by PO # 152-12.

4. The applicant completed his tour as a Drill Sergeant and on 31 August 2007 he was awarded the Army Commendation Medal by PO # 243-22 in recognition of 2 years of meritorious drill sergeant duty.

5. One each of the above certificates are filed on the applicant's OMPF.

6. Army Regulation (AR) 600-8-22 (Military Awards) sets forth Department of the Army criteria, policy and instructions concerning individual military awards, the Good Conduct Medal, service medals and service ribbons, combat and special skill badges and tabs, unit decorations, and trophies and similar devices awarded in recognition of accomplishments. It also provides, in pertinent part:

	a. only one decoration will be awarded to an individual or unit for the same act, achievement, or period of meritorious service; and

	b. award of a decoration in recognition of a single act of heroism or meritorious achievement does not preclude an award for meritorious service at the termination of an assignment.

DISCUSSION AND CONCLUSIONS:

1. The applicant requests that duplicate awards be removed from his OMPF. He provides copies of three award certificates, but does not specify which certificates are duplicates and should be removed.

2. The applicant received an Army Achievement Medal for achievement in being chosen as Battalion Drill Sergeant of the Quarter. He then competed for Drill Sergeant of the Quarter at brigade level.

3. The applicant received an Army Achievement Medal for achievement in being chosen as Brigade Drill Sergeant of the Quarter. Being chosen Battalion and Brigade Drill Sergeant of the Quarter are two separate acts or achievements and, by regulation, may be recognized separately.

4. The applicant received an “end-of-tour” award of the Army Commendation Medal for meritorious service as a drill sergeant. By regulation, this award for meritorious service at the termination of his drill sergeant assignment was not precluded by his previous awards for Battalion and Brigade Drill Sergeant of the Quarter.

5. There is no error or injustice. There does not appear to be any duplication of award certificates; the applicant is entitled to all three awards.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

___X_____ _____X___ ___X_____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.
