THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that block 9 of his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to reflect that he was transferred to the 422d Civil Affairs Battalion, 1120 N. Church Street, Greensboro, NC  27401-1008.

2.  The applicant states that he was not transferred to the United States Army Reserve (USAR) Control Group (Reinforcement) as his DD Form 214 reflects.  He goes on to state that he was transferred to the 422d Civil Affairs Battalion, 1120 N. Church Street, Greensboro, NC  27401-1008, and his DD Form 214 should be corrected to reflect that information.

3.  The applicant provides a memorandum on his unit letterhead requesting correction of his DD Form 214 and is signed showing him as the commander of the unit in question, a copy of his assignment orders, and a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant was serving in the rank of major in the USAR Control Group (Reinforcement) when he was ordered to active duty on 25 June 2007 in support of contingency operations for active duty operational support at Fort Bragg, North Carolina.

2.  On 24 April 2008, orders were published by the Human Resources Command, St. Louis, Missouri, which voluntarily reassigned the applicant from the USAR Control Group (Reinforcement) to the 422d Civil Affairs Battalion, 1120 N. Church Street, Greensboro, NC  27401-1008, effective 22 April 2008.

3.  On 16 May 2008, the applicant was honorably released from active duty (REFRAD) due to completion of required service.  His DD Form 214 issued at the time of his REFRAD reflects in block 9 that he was transferred to the USAR Control Group (Reinforcement).

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contention that his DD Form 214 should be corrected to reflect that he was transferred to the 422d Civil Affairs Battalion, 1120 N. Church Street, Greensboro, NC  27401-1008, has been noted and found to have merit.

2.  Orders were published just prior to the applicant's REFRAD that assigned him to the 422d Civil Affairs Battalion and where he currently serves as the commander of that unit.

3.  Accordingly, his DD Form 214 dated 16 May 2008 should be corrected to show in block 9, that he was transferred to the 422d Civil Affairs Battalion, 1120 N. Church Street, Greensboro, NC  27401-1008, vice the USAR Control Group (Reinforcement) that is currently reflected in that block.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing in block 9 of his DD Form 214, dated 16 May 2008, that he was transferred to the 422d Civil Affairs Battalion, 1120 N. Church Street, Greensboro, NC  27401-1008, instead of the USAR Control Group (Reinforcement).
